Councilmember Anderson stated that she would like this issue addressed at a work session since <br />she does not believe it is good public policy to allow building prior to the CUP being issued. <br /> <br />Councilmember Hendriksen stated that he would like to see the CUP for the Armstrong and <br />Kurak properties. He stated that he served on the Planning Commission when they were <br />considered and thinks there was a great deal of concern expressed about building multiple <br />structures since it results in the difficulty of refusing it for anyone else. Councilmember <br />Hendriksen stated that this is actually rental property since services are being exchanged for <br />housing so it is even beyond the two cases cited in the report. '-- <br /> <br />Councilmember Anderson stated that she has a different concern about obtaining the permit prior <br />to construction. <br /> <br />City Administrator Norman stated that, in this case, there was a problem three months ago with <br />staffing levels and some things "fell through the cracks." He explained that Mr. Kveton was a <br />victim of sorts due to turnover of planning staff and when he came in, the newly appointed <br />Community Development Director was on medical leave. City Administrator Norman explained <br />that this issue was to be addressed two months ago but got lost in the system. <br /> <br />Councilmember Anderson stated it appears people are told they can go ahead but it would be at <br />their own risk, which she does not believe is good public policy. <br /> <br />Councilmember Hendriksen asked if a building permit was granted for this house and <br />Community Development Director Frolik replied that it was. <br /> <br />Mr. Kveton stated that a house is constructed and completed on this site. He stated that he <br />applied for and received a building permit for the house. <br /> <br />Mayor Pro tem Zimmerman stated this is an internal staffing problem. <br /> <br />Councilmember Hendriksen asked when it was known that a CLIP was needed. <br /> <br />City Attorney Goodrich stated he would need to review the CLIP and the conditions of the <br />issuance. He stated if there are several outstanding issues, the matter could be tabled. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to table <br />consideration of the resolution adopting the Findings of Facts relating to Mr. Kveton's request <br />for a conditional use permit for two dwellings on one parcel and a request for a conditional use <br />permit based on the findings of fact and table adoption of the resolution declaring terms of same, <br />including the construction of a Class 5 temporary cul-de-sac until a legal opinion can be obtained <br />along with additional information. <br /> <br />Motion carried. Voting Yes: Mayor Pro tem Zimmerman, Councilmembers Hendriksen, <br />Connolly, and Anderson. Voting No: None.
