Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Kurak, Elvig, Pearson,
Strommen, and Zimmerman. Voting No: None.

Case #6:

Request for a Conditional Use Permit to Exceed Size Restrictions for
Accessory Structures; Case of Michael St. Hilaire

Community Development Director Frolik stated that City Code restricts accessory structure
building size based on the size of the parcel. The City has received an application from Michael
St. Hilaire for a conditional use permit to exceed the detached accessory building size restrictions
established in City Code on the property located at 6251 169th Lane NW. The subject property is
approximately 1.75 acres in size; City Code restricts accessory buildings to 1,664 square feet on
parcels this size. The applicant is proposing to construct a detached garage that would be 1,200
square feet. Based. on the existing accessory square footage, the new building would exceed the
allowable total for the parcel by 352 square feet. The applicant is requesting the additional square
footage to construct a building to store personal property. The applicant is limited to three
accessory structures on the property. The proposed detached accessory building will comply
with all of the setback requirements and accessory structure height restrictions established in City
Code. The applicant is proposing aluminum or hardboard siding for the structure to match the
color of the house (which has hardboard siding with brick detailing). Code violations relating to
unlicensed and/or inoperable vehicles and other outdoor storage have occurred on the property in
the past; in light of this fact, staff recommends granting the request for additional storage. The
Planning Commission and staff recommended granting the request for conditional use permit.

Councilmember Elvig stated that he has been by the site and the reason the Council would grant
a conditional use permit for this property is to get the stuff currently stored outside covered. He
inquired if it was going to be possible to get all the stuff currently stored outside in the new
building.

Michael St. Hilaire, 6251 169th Lane NW, Ramsey, replied that some of the stuff will be going
inside the building, but not all of it. The purpose of the structure is too clean up the yard, but it
will be impossible to get everything in the structure.

Councilmember Elvig inquired as to how the City could require that the property get cleaned up
enough so that it is not a concern for the neighbors.

Mr. St. Hilaire replied that the structure will help clean up the front yard.

Councilmember Elvig inquired if maintenance of property is being looked at as part of the
Chapter 9 re-write.

Community Development Director Frolik reviewed the current City code.

Councilmember Elvig requested that the Council review the ordinance because if in fact the
property is in compliance with the current ordinance then they need to clean up the ordinance.

City Council/August 26, 2003
