plan amendment to change the residential properties from 'Places to Work' to Low Density <br />Residential. Some of the reasons the City Council gave in favor in changing the designation <br />back to Low Density Residential was that there was not any pending plans to redevelop the <br />neighborhood and the fact that the Employment Zoning District designation will make the <br />residential units non-conforming uses and cause problems for residents with their mortgage <br />companies. At their August 7, 2003 meeting, the Planning Commission held a public hearing <br />regarding the proposed amendment to the Comprehensive Plan and recommended that the City <br />Council approve the proposed land use change from 'Places to Work' to Low Density <br />Residential. Staff recommended approval of the Comprehensive Plan Amendment to change the <br />seven lots on Rivlyn Avenue from 'Places to Work' to Low Density Residential. <br /> <br />Councilmember Elvig suggested that this area be designated as mixed-use as well. <br /> <br />Councilmember Kurak stated that at anytime this area is redeveloped it would be purchased <br />entirely by a developer and it would not likely be done on an individual basis and at that time the <br />developer could request a zoning change. <br /> <br />City Administrator Norman noted that there are currently proposals to buy individual properties. <br /> <br />Councilmember Zimmerman replied that the residents are the ones that made the request to <br />change the zoning back to low density residential. <br /> <br />City Administrator Norman replied that the residents were concerned that the proposed zoning of <br />Industrial restricted the use of their properties and made it difficult to refinance or sell their <br />homes. <br /> <br />Jack Newcomb stated that he started the petition and lives at the west end of the street. He <br />personally has not received any requests to sell his property nor has anyone else that he knows of. <br />The original proposal was to change the zoning to E-1 and it would make refinancing of their <br />homes very difficult. The issue of designating the land as mixed-use was never discussed with <br />the residents. He requested that the zoning be changed back to residential as it has always been. <br /> <br />City Administrator Norman explained that mixed -use allows for both options. <br /> <br />Mr. Newcomb stated the only options presented to the residents were residential or commercial, <br />mixed use was never discussed. <br /> <br />Councilmember Elvig stated that he has heard that someone made an offer on one of the <br />properties, which is why he was recommending the designation of mixed use. He inquired if Mr. <br />Newcomb was opposed to zoning the property mixed use. <br /> <br />Mr. Newcomb replied that he did not know without having further information. <br /> <br />Councilmember Elvig recommended that they table action to allow for more time to discuss the <br />issue. <br /> <br />City Council/August 26, 2003 <br /> Page 19 of 25 <br /> <br /> <br />
