description of the equipment used in each concession and a description of the premises <br />where the carnival is to be carried on, written permission of the owner of the premises <br />where the carnival is to be conducted, the certificate, affidavit, and a copy of the <br />inspection report required pursuant to Minnesota Statutes, Chapter 184B, a~.ad proof of <br />compliance with said Statute, and such other and further information as the City may <br />from time to time require. , <br /> <br /> Subd.4. Review and Approval. The City Clerk or designee shall verify <br />the information in the application and conduct such investigation as required by the City. <br />The applicant shall provide evidence of written permission for the operation of the <br />carnival from the owner of the location of the premises. The City Clerk shall require <br />review and recommendation from the Fire Chief and Police Chief and shall forward the <br />license request to the City Council for action. The City Council reserves that right to <br />require a public hearing on the application and such hearing shall be held at such time <br />and upon such notice. <br /> <br /> Subd.5. Conditions. The Council may impose any conditions or impose <br />restrictions it deems necessary or advisable to protect the public health, safety, welfare, <br />including but not limited to conditions relating to the hours of operations, the lighting of <br />the premises, and the parking facilities. The Council may impose any conditions or <br />restrictions at any time after the issuance of a license hereunder. <br /> <br /> Subd.6. License Fee; Expiration. The fees for licenses issued under this <br />Section, shall be set by City Council resolution. The fee shall be paid at the time the <br />application in submitted to the City Clerk. If the Council denies an application for the <br />license, the amount paid shall be refunded, after deducting twenty-five ($25.00) for the <br />cost of processing the application. Every such license shall specify the period of time for <br />which it is issued and shall expire at the end of the period state therein. <br /> <br /> Subd.7. Insurance. Each applicant required to obtain a license pursuant to <br />this Section shall furnish an insurance policy or certificate, naming the City as an <br />additional insured, and keep in full force and effect proper liability insurance to protect <br />the City and said licensee against any claims or liability for personal injury or property <br />damage sustained by any persons as a results of the operation, as set forth below: <br /> <br />Any applicant operating amusement rides shall obtain the type and <br />amounts of insurance as required by Minnesota Statutes, Section 184B.02; <br /> <br />bo <br /> <br />Any carnival applicant not subject to Paragraph A shall provide general <br />liability insurance coverage in the amount of $500,000.00 per occurrence <br />and $500,000.00 general aggregate; <br /> <br />Co <br /> <br />In addition to the insurance required in Paragraphs a & b above, any <br />carnival applicant serving food to the public shall provide product liability <br />coverage in the amount of $500,000.00 per occurrence and $500,000.00 <br />product aggregate. <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />$1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> <br />
