Forward to Council. <br />Frolik/Olson/ 06/01/99 Re Dolphin Real Estate request for CUP: The Planning <br />Complete Commission recommended that City Council adopt Findings <br /> of Fact with the following changes: #7 to read "That the <br /> applicant is going to erect a sign for the new Burger King <br /> facility on the Subject Property that will exceed the area and <br /> height restrictions established by City Ordinance.", #9 to read <br /> "That a conditional use permit to exceed sign size restrictions <br /> by 45 feet will not grant the Applicant special privileges that <br /> are denied by the City Code to other properties in the <br /> commercial area.", #10 to read "That a conditional use <br /> permit to exceed sign height restrictions consistent with <br /> adjacent properties will not grant the Applicant special <br /> privileges that are denied by the City Code to other properties <br /> in the commercial area.", #11 to state the sentence "That the <br /> proposed increase in sign surface will be designed so as to be <br /> harmonious and appropriate in appearance with the existing <br /> or intended character of the vicinity and will not change the <br /> essential character of the area.", #12 to state the sentence <br /> "That the proposed increase in sign height, to the extent <br /> deemed necessary to conform with adjacent signage, will be <br /> designed so as to be harmonious and appropriate in <br /> appearance with the intended character of the vicinity and will <br /> not change the essential character of the area.", and #13 - 24 <br /> should all read "will not." approve. The Planning <br /> Commission recommended City Council approve the issuance <br /> of a CUP for Dolphin Real Estate based on the amended <br /> findings of facts, and adopt a resolution declaring terms of <br /> same, making the following changes to #1: "The Permittee <br /> is herein granted permission to erect a fi'eestanding pylon sign <br /> with a business identification sign surface area not to exceed a <br /> 100 square feet, and a reader board not to exceed 45 square <br /> feet, at a height consistent with adjacent signage."
