Councilmember introduced the following resolution and moved for its , zloption: RESOLUTION #98-02- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO OPERATE A TWO FAMILY DWELLING UNIT IN THE R-1 RURAL RESIDENTIAL DISTRICT WHEREAS, Scott and Gwyn Simpson have properly applied for a conditional use permit ("Permit") to operate a dwelling in the single family district as a two unit rental building on the property generally known as 16001 Nowthen Blvd. N.W. and legally described as follows: That part of the east 100 feet of the Northeast Quarter of the Southeast Quarter of Section 15, Township 32, Range 25, Anoka County, Minnesota lying northeasterly of the County State Aid Highway Number $ (also known as Nowthen Boulevard. WHEREAS, the Planning Commission met on February 3, 1998, conducted the public hearing and recommended City Council denial of the request based on the findings of fact proposed; and WHEREAS, the City Council reviewed the facts and amended the findings of fact in the positive. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: e o o Based on Findings of Fact #0 , a conditional use permit (the "Permit") for a two family rental unit within the single family district is hereby granted to Scott and Gwyn Simpson, (the "Permit Holder"), at 16001 Nowthen Blvd. N.W. (the "Subject Property"). Tha? said Permit shall remain in effect so long as the conditions imposed herein are complied with. That the structure exterior shall not be further altered to promote the appearance of a two unit structure. That :he structure shall not be further altered to render it marketable as a condominium. That there shall be no more than 2 family units occupying the structure at any given time. For purposes of this Permit, a family unit shall be defined as follows: an individual or two (2) or more persons related by blood, marriage or adoption, or a group of not more than five (5) persons (excluding servants) who need not be related by blood, marriage or adoption living together in a dwelling unit.
