This proposed ordinance amendment affects lands within the designated Mississippi Wild, <br />Scenic, and Recreational River district and the designated Mississippi River Critical Area Corridor. <br /> <br />In order to ensure that the standards and criteria are not nullified by unjustified exceptions in <br />particular cases, and to promote uniformity, a review and certification procedure by the Department <br />of Natural Resources (DNR) is established for amending an ordinance affecting the Mississippi Wild <br />and Scenic River district. No such ordinance amendment becomes effective unless and until the <br />commissioner has certified the action complies with the intent of the Wild and Scenic River Act and <br />the minimum standards and criteria [MN 'Rules, part 6105.0230]. <br /> <br />The City proposes to repeal Section 9.21.07, Subd. 2. c.l. item (b) requiring nonconforming lots to <br />be in separate ownership from abutting lands in order to be allowed as a building site. MN Rules, <br />part 6105.0110, subpart 1, paragraph 2 requires: <br /> <br />If in a group of two or more contiguous ]ots under a single ownership any individual lot does <br />not meet the lot width requirements of the local ordinance, such individual lot cannot be <br />considered as a separate parcel of land for purposes of sale or development, but must be <br />combined with adjacent lots under the same ownership so that the combination of lots will <br />equal one or more parcels of land each meeting the lot width requirements of the local <br />ordinance, or to the greatest extent practicable. <br /> <br />Under thc City's proposal to repeal one of the conditions for allowing nonconforming existing lots of <br />record as building sites, the Commissioner would be precluded from certifying this ordinance <br />amendment since it is less restrictive than the minimum required criteria. Minnesota Statutes and <br />Rules pertaining to the Mississippi River are very consistent that local units of government cannot <br />adopt ordinances less restrictive than the minimum standards. <br /> I)NR Ii~.rotm:~lioll: fi12.29fi.bl 5'i.
