He would then request it not be in the <br />moratorium since it is zoned industrial and within the MUSA. <br /> <br />City Attorney Goodrich stated there is a procedure to exempt property fi.om the moratorium <br />when and if it is included in the moratorium. He 'agreed that the proposed ordinance for next <br />week would include Mr. ~ohnson's property in a moratorium. City Attorney Goodrich stated <br />those exclusions are considered on a case-by-case basis and Mr. Johnson's case can be argued at <br />the next meeting when the ordinance is considered for introduction. <br /> <br />Mx. Johnson asked if his proposal can move forward even [fin the process. <br /> <br />Ms, Frolik explained that Mr. Johnson's property is zoned industrial, in the MUSA and not in the <br />current moratorium. However, if Mr, lohnson is requesting a residential use then it would be <br />automatically included in the moratorium. <br /> <br />Mayor Gamec requested that Mr. lolmson work with Staff'on this issue. <br /> <br />Councilmember Haas Steffen stated even if this property is not within the moratorium, once Mr, <br />Jolmson or the buyer comes in to request a subdivision and rezoning to residential, that move <br />alone would sweep the property into the moratorium, regardless of the action taken by the <br />Council tonight or at the next meeting. She stated if Mr, ;rohnson goes ahead there is a procedure <br />to address his request for exemption but that may or may not be approved. <br /> <br />Motion by Councilmember Haas Steffen and Councilmember Beahen to direct staff to prepare a <br />moratorium ordinance to include sensitive properties which were not previously included in the <br />moratorium with the recommendation from Hoisington Koegler. <br /> <br />Motion Carded. Voting Yes: Mayor Garnet, Councilmembers Haas Steffen, Beahen, Beyer, and <br />Zimmerman. Voting No: None. <br /> <br />Case #i0: Request for Selection of Site for Senior Housing Development Project <br /> <br />Mayor Garnet noted this has been previously discussed and five potential sites were identified. <br /> <br />City Administrator Norman stated the site selection was narrowed from the original five down to <br />two sites and the Committee recommended that the senior housing project be developed on one <br />of the two preferred sites; the property formerly known as the Laws property and the property <br />located on the most westerly section of River's Bend Park. <br /> <br />Couneilmember Haas Steffen stated she spent a lot of time looking at these sites and traffic issues <br />and the Chamber of Commerce and businesses are concerned about traffic congestion so she <br />supports the Laws property. Also, it was given to the City for use as park property. She noted <br />the area used for sledding which could contain smaller and bigger hills and stated safety issues <br />would have to be addressed to cover the pump. Couneilmember Haas Steffen indicated support <br />to use the Laws site as long as there is not a problem with the water tower.
