He explained that MnDOT wants it moved <br />farther back to the point they are willing to contribute $40,000 to accomplish that. <br /> <br />Mayor Gamec stated his support if this issue can be reviewed without holding up the project. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to authorize <br />execution of the agreement between the Anoka West Pet Hospital, Inc., Minnesota Department of <br />Transportation, and Dolphin Real Estate Partnership subject to Hoisington Koegler Group, Inc. <br />approval of the citing of the service road on the subject parcels from a reasonable City Planning <br />aspect. <br /> <br />Councilmember Zimmerman asked if$40,000 will be adequate. Mr. Jankowski stated it should be <br />adequate. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, and <br />Zimmerman. Voting No: None. Absent: Councilmember Beyer. <br /> <br />Case #5: Authorization to Retain Legal Counsel for Storm Water Management Matters <br /> <br />City Administrator Norman explained the City retained the services of Charles LeFevere from the <br />firm of Kennedy and Graven, to study storm water management and County ditch matters within <br />the City of Ramsey. I-Ie noted Mr. LeFevere's letter dated September 16, 1998, addressing the <br />issues and recommending the City enter into an agreement with the Lower Rum River Watershed <br />Management Organization (LRRWMO). Staffmet with the LRRWMO Board on September 17, <br />1998, and proposed the previously described agreement. However, since the LRRWMO already <br />utilizes the services of Mr. LeFevere and the Board would require Mr. LeFevere's services to <br />review any proposed agreement, they requested the City of Ramsey retain the ser'Aces of a <br />different attorney to prepare a proposed agreement. Mr. Norman advised that Staff contacted the <br />State Board of' Water and Soil Resources who recommended various persons who specialize in <br />ditch and watershed issues. Mr. Raymond O. Marshall from the firm of Lawson, Marshall, <br />McDonald & Galowitz, P.A., in Lake Elmo, Minnesota, was contacted and agreed to provide the <br />services as requested by the City. Staff recommends the Council retain the services of Raymond <br />O. Marshall to provide services related to storm water management issues. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Haas Steffen to authorize <br />retaining the services of Raymond O. Marshall from the firm of Lawson, Marshall, McDonald & <br />Galowitz, P.A. to provide services related to storm water management issues. <br /> <br />Councilmember Haas Steffen advised that the LRRWMO is fearful that this process not cost the <br />other member cities anything.
