I <br /> <br />I <br />I <br /> <br />I <br /> <br />I <br />I <br />I <br />i <br /> <br />Joint Powers Agreement Establishing the <br />Northstar Corridor Development Authority <br />By: Ryan Schroeder, City Administrator <br /> <br />CASE <br /> <br />Background: <br /> <br />On March 11, 1997, by Resolution #9%03-053, Council provided support to the T.H. #10 <br />Multi-Modal transportation corridor development. As part of this resolution, the City <br />directed the Mayor and City Administrator to work toward development of a joint powers <br />agreement to facilitate furtherance of the project. On March 18, 1997, we received a draR <br />of the Joint Powers Agreement fi.om Anoka County. On March 24, 1997, we received <br />comments fi.om Attorney Goodrich recommending changes to the agreement. On April <br />6, 1997, a meeting was held between parties eligible to be members of the organization <br />contemplated by the agreement. On April 10, 1997, we received a second draft of the <br />agreement from comments received at the April 6, 1997 meeting. This agreement is <br />enclosed for your review and consideration. <br /> <br />Several changes have been made to the agreement between drafts. Of the three suggested <br />by Attorney Goodrich, two were addressed. The third relates to the concern that the <br />organization purchase liability coverage. Council is reminded of the MPRS lawsuit <br />wherein that organization, to which we were members, did not carry such insurance. The <br />member cities were exposed to lawsuit expenses as a result. The language in this <br />agreement allows for purchase of insurance coverage but does not mandate it. Whoever <br />is appointed to the board from Ramsey should insure that that situation is addressed. <br /> <br />The purpose of this joint powers organization is to provide an entity to analyze the <br />feasibility and environmental impacts of integrated transportation improvements along <br />the Highway #10 corridor. Included would be highway improvements, commuter and <br />freight rail, recreational trails, ITS, safety, and related land use issues. It is an <br />organization comprised of governments. The eligible membership includes the Counties <br />and their rail authorities of Anoka, Hennepin, Steams, Sherburne, and Benton. Also <br />included are all cities and townships within those counties. The board will consist of an <br />elected official and alternate from each member jurisdiction. The alternate may be either <br />an elected member or staff person. <br /> <br />The initial funding of the organization is proposed to be fi.om outside sources. Revenues <br />necessary beyond potential grant sources will be provided by the Counties and Rail <br />Authorities. By July 1 of each year, the organization will develop a budget with a <br />proposal for any contributions from members at that time. Council should note that in the <br />first draft it was contemplated that Ramsey would contribute $2,000 towards start-up <br />expenses. Therefore, it is reasonable to expect that a contribution request will be <br />forthcoming for 1998. <br /> <br /> <br />
