ORDINANCE #97-__ CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AN AMENDMENT TO CHAPTER 4 WHICH IS KNOWN AS THE PUBLIC FACILITIES AND IMPROVEMENTS CHAPTER OF THE CITY CODE OF RAMSEY, MINNESOTA. AN ORDINANCE ADDING SECTION 4.80 -CONNECTION FEE FOR STORM SEWER SYSTEM AVAILABILITYft, TO CHAPTER 4 OF THE CITY CODE OF IL%MSEY, MINNESOTA. The city of Ramsey ordains: 4.80.01 PURPOSE It is the purpose of this Ordinance to implement the intent of the city of Ramsey that all property within the City shall pay an equivalent amount for the availability of storm sewer systems and related facilities. 4.80.02 AUTHORITY This Ordinance is adopted pursuant to the authority granted the city by MSA 444.075 to collect a connection charge for the use and availability of storm sewer systems and related facilities. 4,80.03 EXAMINATION OF SPECIAL ASSESSMENT ROLLS The City's Special Assessment Rolls shall be examined to determine if an assessment for the full cost of furnishing the availability of a storm sewer system and related facilities to the subject premises has been paid. 4.80.04 PAYMENT OF CONNECTION CHARGE If an assessment has not been paid or levied against the subject premises for the storm sewer system and related facilities, the city shall collect a connection charge pursuant to MSA 444.075, prior to issuance of any building permit for the subject premises. If a special assessment as applied to the subject premises is determined to be invalid for any reason, the connection charge referred to herein shall become payable by the owner of the subject premises at the time of such determination. 4.80.05 CONNECTION CHARGE AMOUNT The City shall determine the amount of the connection charge as provided in MSA 444.075 and shall consider the costs of providing trunk services to the area and the actual cost of serving adjoining properties or properties served at approximately the same time,
