Administrator shall cause the cle_~up assessment to be levied <br /> against the property on which the system is located. <br /> <br /> Sub& ~. Liability. The pl-mbing inspector or any employee charged <br />with the enforcement of' this Chapter of. the City, acting in good faith ~d v~thout <br />malice £or the discharge of. his duties, shall not thereby render himself, liable <br />personally, _~nd he is hereby relieved from all personal Hability for any d~age that <br />may accrue to persons or property as a result of' ~y act required or by reason of. stay <br />act or omission in the ddscharge of. his duties. Any suit brought against the <br />plumbing inspector or employee because of. such act or omission performed by him <br />in the enforcement of any provision of this chapter shah be de~med by the legal <br />department of the City of Ramsey until final te ~rmlnation of the proceedings. <br /> <br /> SutxL3. Cooperation Of Other Official~, The pl-mbing inspector <br />authority may request, and shall receive so far as may be necessary in the <br />discharge of his dudes, the assis~nce and cooperation of the other o~c~als of the <br />City of l~m~ey. <br /> <br /> ~ 4. Appeals. Appeals from the plumbing inspector's decision <br />and requests for variances as to any provisions of this chapter may be made to the <br />l~msey City Council. The City Council may gr_~nt a variance to the strict terms or <br />requirements of this chapter as ~t ~fFects specific tracts of land if it finds: <br /> <br /> a. It ~s shown by reason of topography or other physibal conditions <br /> that strict compliance with the chapter's requirements could <br /> cause an exceptional and undue hardship to the enjoyment of a <br /> substantial property right; <br /> <br /> b. By the gra~ting of the variance, the spirit and intent of the <br /> chapter will not be adversely affected; <br /> <br /> That the variance will not be injnrious to the health and/or <br /> general welfare off <br /> <br />I. the users of the system for which the variance is sought, <br /> <br />2. the adjacent property owners, and <br /> <br />3. the general comm-~ty as a whole; <br /> <br />That the establishment, maintenance or operation of the system <br />as pernmitted by the variance will not be detrimental to or <br />endanger the:public health, safety or Eeneral welfare and is not <br />contrary to established standards, re,inflations or ordinances of <br />other governmental agencies. <br /> <br /> Histo~ Note <br /> <br /> Established by Ord. 73-11, August 20, 1973. <br /> Orch 84-2 replaced $8.30 in whole. <br /> <br /> Ord. 8946 repealed $8.30.04 Subd. 8b, entitled <br />"Collection Systems" and replaced it with a <br /> <br />section entitled "Communal Disposal <br />Systems." <br /> <br /> Repealed $8.30.04 Subd. 8c, entitled "Seepage <br />Pits" and replaced it with a section of the same <br />title. <br /> <br />~Y4.~ ~rinted 12/28/90 <br /> <br />Page 267 <br /> <br />I1 <br />II <br /> <br /> <br />
