Any person who commlt~ a~ly of the following acts or violates any of the provisions of this chapter which prescribe that certain action is ,mlawful shall be guilty of a misdemeanor, and upon conviction' thereof' shall be fined in an amount not to exceed $700.00 for each violation and/or 90 days in jail. Each day that ,mlawful activity continues shall constitute a separate violation: 1. Disposes of sewage or installs or renovates an individual sewage treatment system without first having received a permit as provided herein. 2. Installs or renovates an individual sewage treatment system or discharges sewage in a manner which involves the knowing and material variation from the terms and spe~i~cations contained in the application or permit. 3. Violates the terms of an order issued pursuant to the provisions contained herein. 4. Conducts the business of or engages in activities described in §8.30.05 Subd. 6 herein without first having obtained the required license. 5. Willfully fails to conduct the testing or. cleaning obligations established pursuant hereto or unlawfully refuses a right of entry to the administrator when requisite notice has been provided. The pi-robing inspector may by written order suspend or revoke any disposal or system permit when he has information indicating that the permit has been issued in error or on the basis of incorrect or inadequate information or that work is not being performed in compliance with this section or the provisions of any permit issued hereto. b. Cease ~nd Desist Order. The administrator may issue an order to the owner or occup~,~t of any premises utilizing an indixddual sewage treatment system to cease and desist the use of any system which is operating in a manner creating substantial hazard to the public, health, safety, or welfare or which has not been repaired in accordance with the provisions of an order issued pursuant to '§8.30.08 herein. A noticed public hearing shall be held within 14 days f6Ilowing the issuance of such an order to determine whether the order should be continued in force and effect. The plumbing inspector may cause to be assessed against the property on which an individual sewage treatment system is located the cost of proper closure, restoration and cleanup of as a result of a system failure.
