These covenants <br />and restrictions may be amended from time to time by written <br />instrument signed by the Owners of a majority of the Lots; <br />provided, however, that so long. as Developer is the Owner of any <br />Lot, the written consent of Developer to any such amendment shall <br />be required before any such amendment shall become effective. <br /> <br />2.31 Enforcement. Developer or the Architectural Review Committee <br />shall have the right to enforce, by a proceeding at law or in <br />equity, the performance of'the covenants and restrictions contained <br />herein, including without limitation the right to institute and <br />prosecute proceedings against any party violating or attempting to <br />violate said covenants and restrictions, the right to seek recovery <br />of damages, and the right to seek any other lawful remedies. <br />Failure by any party to enforce any covenant or restriction herein <br />contained shall in no event be deemed a waiver of the right to do <br />so thereafter. <br /> <br />~.32 Severabilit¥. Invalidation of any one? of these <br />covenants or restrictions by judgment or court order shall <br />in no ~.y affect any other provision hereunder, which other <br />provisions shall remain in full force and effect. <br /> <br />ARTICLE III <br />COMMITTEE <br /> <br />3.1 Architectural Supervisory Committee. Declarants have <br />created an Architectural Supervisory Committee. The said <br />members and any authorization, approval or waiver made by <br />the Committee must be signed by a majority of the members <br />thereof. The Architectural Supervisory Committee shall be <br />synonymous with the Architectural Review Committee. <br /> <br />3.2 Architectural Control. No residential or other <br />structure, and no fence, wall, garage, outbuilding or other <br />structure, nor wire, pSpe, cesspool, septic tank, well, <br />path, walkway, hedge, d~iveway, serial, antenna or exterior <br />ornament of any kind, nor any addition, alteration or <br />remodeling thereof, including repainting or redecorating, of <br />the exterior, shall be made, erected, altered,, placed or <br />permitted to remain on any portion of the premises herein <br />conveyed unless and until detailed plans and specification <br />and proposals have been filed with, and the external design, <br />the colors and color scheme, the decoration, the <br />construction and the material to be used in construction, <br />the dimensions, and the location thereof have been approved <br />in writing by the said Architectural Supervisor~.Committee. <br /> <br /> <br />
