UU~ <br /> <br />Motion by Commissioner I. aff)ue and seconded by Commissioner Terry to accept Finding of Fact No. <br />27 as amended to indicate that proposed uses and activities are controlled by City Code and should <br />the permit be granted, these private rights will be protected by the Code under the contract the <br />permit-tee signs with the City. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Deemer, Commissioners L~Due, Terry, and <br />Thom& Voting No: None. Absent: Chairman Bawden, Commissioners Jensen and Holland. <br /> <br />Motion by Acting Chairperson Deemer and seconded by Commissionex LaDue to add Finding of No. <br />Fact 28 indicating that the excavation on the southeast side of the project will leave an 18 foot high <br />bluffalong Sunfish Lake and a 13 foot high bluffon the eastern wetland. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Deemer, Commissioners LaDue, Terry, and <br />Thorad. Voting No: None. Absent: Chairman Bawder~ Commissioners Jensen and Holland. <br /> <br />Commi.~sianer LaDue suggested adding a finding that this parcel is within the Shoreland District of <br /> Lake. City Engineer Jankowski advised this is already included in Findings of Fact No. 14. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to accept the amended <br />Findings of Fact. <br /> <br />Motion carried. Voting Yes: Acting Chakperson Deemer, Commissioners LaDue, Terry, and <br />Thorud. Voting No: None. Absent: Chairman Bawden, Commissioners J'ensen and Holland. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Acting Chairman Deemer noted the need to correct Findings of Fact No. 3 to reflect the acreage <br />stated. Also, the City Engineer has recommended a revision to the proposed phasing (item ~4) to <br />require grading the northexn most portion to the proposed final contours as established by the final <br />grading plan and tree line screen be established. <br /> <br />Mr. Kurak stated he agrees with th{_, condition. <br /> <br />At the request of the audience, Zoning Administrator Frolik read each condition of the permit under <br />consideration. <br /> <br />Acting Chairperson Deemer asked if Finding of Fact No. 7 incorporates the entire 39 acres and <br />suggested it be modified to exempt equipment located on the homestead. <br /> <br />City F~ngineer Jankowski suggested the condition except personal property. The Planning <br />Commission agreed and directed that the following words be included at the end ofthe last sentence <br />"excepting personal property." <br /> <br />City Engineer Jankowski advised that Finding of Fact No. 9 may not be required since City Code <br />indicates a maximum amount of reforestation.
