Item No. 2 of that letter states <br />that the conditions of the City's shoreland ordinance are met by both the Pondview Preliminary Plat and the <br />Sunfish Estates Sketch Plan. After it was brought to my attention and after giving it further review, both <br />proposals have problems with the lot sizes. <br /> <br />PONDVIEW PRELIMINARY PLAT <br />Public waters wetland 2-118P has a shoreland classification of General Development, with a minimum lot size of <br />15,000 square feet for flpadan lots and 10,000 square feet for non-riparian in sewered areas. Ivfmnesota Rules <br />Part 6120.3300, Subpart 2., Item A~ states in part, "...Only land above the ordinary high water level (OHW) of <br />public waters can be used to meet lot area standards...". Eighteen of the riparian lots do not meet the required <br />15,000 square feet above the OI-IW. <br /> <br />Lot widths at the OHW and at the building line all appear to be acceptable. <br /> <br />SUNFISH ESTATES SKETCIt PLAN <br />Sunfish Lake (public waters basin No. 2-113P) is classified a Recreational Development lake and requires a <br />20,000 square feet and 15,000 square feet lot size for riparian and non-riparian lots, respectively, in sewered <br />areas. Again Ivfinnesota Rules require that the minimum lot size be calculated above the OHW. Only 2 or 3 of <br />the non-riparian lots meet the 15,000 square foot lot size and it is difficult to tell at this time if any of the riparian <br />lots have sufficient area above the OHW. <br /> <br />I apologize for missing these obvious problems in my first letter.
