5) Schedule 1997 Community Events <br /> <br /> Finance Officer Hart presented a schedule for the 1997 community events and requested Council <br /> approve of it. <br /> <br /> Motion bY Councilmember Beahen and seconded by Councilmember Zimmerman to approve the <br /> schedules for the 1997 Community Events. <br /> <br /> Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer and <br /> Peterson. Voting No: None. <br /> <br /> MAYOR/CouNCIL INPUT <br /> <br /> 1) City of Ramsey versus Arnold Holmberg <br /> <br /> City Attorney Goodrich reported that the court 'affirmed the finding of a summary judgement in the <br /> City of Ramsey versus Arnold Holmberg. During this process, Larry Holmberg has sold the <br /> Amusement Center property to Arnold Holmberg. This suit has been pending in court for six <br /> years relating to Ordinance #90-23 relating to adult uses. The ordinance was determined <br /> constitutional and Mr. Holmberg appe',ded to the 8th Circuit Court. After the Federal Court <br /> determined it to be constitutional, Holmberg again appealed. The action today determined our <br /> ordinance constitutional and we can enforce it; however, Holmberg has 30 days to again appeal the <br /> decision. <br /> <br /> 2) Moratorium on Applications for a CUP for Group Homes <br /> <br /> Motion by Councilmember Beyer and seconded by Councilmember Beahen to direct staff and the <br /> City Attorney to research and advise the City Council of the legality of placing a moratorium on <br /> applications for a conditional use permit for group homes serving more than 8 persons. <br /> <br /> Motion carried. Voting Yes: Mayor Hardin,'Councilmembers Beyer, Beahen, Peterson, and <br /> Zimmerman. Voting No: None. <br /> <br /> ADJOURNMENT <br /> <br /> Motion by Councilmember Beahen and seconded by Councilmember Beyer to adjourn the meeting. <br /> <br /> Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer, Peterson and <br /> Zimmerman.
