"I think you are stating <br />we should include in the narrative the extension of Armstrong as a County Road". I feel <br />discussion with the County should happen after we approve the document. <br /> <br />Mayor Hardin stated that comments should be given to Ms. Frolik and that Council needs <br />to revisit this. <br /> <br />Council directed that a .special one-hour meeting be scheduled to deal with the <br />comprehensive plan amendment. <br /> <br />Case ~e'/: Report of Easement Acquisition for Section #22 Drainage <br /> <br />City Engineer Jankowski stated that the City-has initiated condemnation action on the <br />Stanley Welsh parcel so that City possession of the easement will commence on March 6, <br />which will allow for the removal of fill placed last fall which blocks the natural drainage, <br />before the spring melt. The Council directed that staff pursue obtaining easements for the <br />remaining parcels. We sent out letters to the remaining 13 parcel owners. To date, we <br />have obtained easement at the offered price of $1,000 per acre from six parcels. In <br />addition, wehave verbal commitment for another parcel. Four parcels remaining are non~ <br />committal plus he has not received a response from one of the parcels. On one parcel, the <br />owner indicated he would sign an easement but for compensation other than what's <br />proposed. In lieu of the $1,000 per acre, which would equate to $230 in this instance, Mr. <br />Boros has asked for Council to split his current four-acre parcel into two parcels of 2.7 and <br />1.3 acres. The non-wetland area of these two parcels would be 1.7 acres and 0.8 acres. <br />The City could create a metes and bounds legal description at relatively little cost, however, <br />the City would forfeit collection of a $600 park dedication fee and would incur <br />approximately $100 in recording fees. Mr. Jankowski advised that none of the remaining <br />properties have requested anything different in terms of compensation beyond what has <br />been proposed by the City. He stated that, to this point, he has not emphasized eminent <br />domain as a vehicle for obtaining the easements but feels that we must proceed to bring this <br />matter to closure. <br /> <br />Councilmember Peterson inquired if in talking with Mr. Boros, has it been mentioned what <br />fees would be expected from him. <br /> <br />Mr. Jankowski replied no, he had not had any contact with him. <br /> <br />Councilmember Peterson suggested that maybe Mr. Boros would consider "picking up" the <br />park dedication fee. "If he would be willing to back up these costs, I could vote in favor of <br />the split." <br /> <br />Councilmember Beyer inquired why metes and bounds - what would lot and block costs <br />be. <br /> <br />Mr. Jankowski felt that it would basically cost $1,500 to just do that. <br /> <br />Councilmember Peterson commented that he thought Mr. Boros just wants the opportunity <br />to split these lots. <br /> <br />City Attorney Goodrich questioned if the City's ordinance lets us do this by metes and <br />bounds. <br /> <br />Zoning Administrator Frolik stated that we have strictly adhered to the 4 in 40. <br /> <br />City Council/January 9, 1996 <br /> Page 13 of 20 <br /> <br /> <br />
