Previously functional private sewer and/or water <br />systems shall be deemed non-functional if a repair <br />of either such systems first requires a permit(s) <br />from the City, State of Minnesota and/or any other <br />regulatory agency. <br /> <br />Subd. 2 <br /> <br />Upon determining that either a private sewer <br />system, a water system, a private water system or <br />both need repair as described herein, the city's <br />Building official shall certify both of said <br />systems as "non-functional". <br /> <br />suba. 3 <br /> <br />An existing home which is serviced by a non- <br />functional sewer and/or water system shall be <br />required to connect to both the City sewer and City <br />water systems within six months of the date on <br />which either of the said systems was declared non- <br /> <br />functional by the City's Building official. <br /> <br />SECTION 5. .$.ALE OF PROPERTY <br /> <br />Upon the s~le ~ ~_ transfer of title of a home by a property <br />owner who e~ected~6~'~ remain on a functional private sewer and/or <br />water sys~e~, and whose property was therefore not assessed for <br />city utilities, the City may levy an assessment on said property in <br />an amount c~nsistent with the original assessment. <br /> <br />SECTION 6. NOTIC~ TO PUBLIC <br /> <br />The City sh~ll cause its public property records to reflect that <br />any propert~ not assessed because the property owner elected to <br />remain on a functional private sewer and/or water system is subject <br />to a pendin~ sewer and/or water system assessment or connection <br /> <br />2 <br /> <br /> <br />
