Economic considerations alone shall not constitute a <br />hardship if a re ~.a~,onable use for the property exists under the terms of the official controls. <br /> Litter Slightly decomposed organic material on the floor of a wooded area. <br /> <br /> l~t A parcel of land designated by metes and bounds description, registered land <br />survey, auditors[plot, or other accepted means and separated from other parcels or portions by said <br />description for ~he purpose of sale, lease, or separation thereof. The <br />ordinary high v}ater mark is commonly that point where the natural vegetation changes from <br />predominantly '~aquatic to predominantly terrestrial. For watercourses, the ordinary high water <br />mark is the elev~ttion of the top of the bank of the channel. <br /> <br /> ~!erson Any individual, firm, corporation, parmership, association or other <br />private or goven tmental entity. <br /> <br /> >lanned Cluster Development A development considered to be a type of <br />Planned Unit De ~elopment and is subject to the same review criteria. <br /> <br /> [!lanned Unit Development A type of development which may incorporate a <br />variety of land Uses planned and developed as a unit. The Planned Unit Development is <br />distinguished f~ Dm the traditional subdivision process of development in that zoning standards <br />such as density, height limits, and minimum lot sizes may be altered by negotiation and agreement <br />between the dew ~loper, the City and the Commissioner of Natural Resources. <br /> <br /> l:trotected Waters* Any waters of the State as defined in Minnesota Statutes, <br />section 103G.IXS, subdivisions 15 and 18. However, no lake, pond or towage of less than ten <br />acres in size and no river or stream having a total drainage area less than two square miles shall be <br />regulated for the~fpurposes of these regulations. <br /> S~tback The minimal horizontal distance between a structure or sanitary facility <br />and the ordinary high water mark, bluffiine, or top of a bluff, or between a smacmre or sanitary <br />facility and a rot ~l, well, highway, or property lines. <br /> <br /> S horeland Land located within the following distances from protected waters: <br /> <br /> a. 1,000 feet from the ordinary high water mark of a lake, pond, or <br /> towage; and <br /> <br /> b. 300 feet from a river or stream, or the landward extent of a flood plain <br /> o~'su~h rivers or streams, whichever is greater. The practical limits of <br /> sh0relands may be less than the statutory limits where such limits are <br /> designated by natural drainage divides at lesser distances, as shown on <br /> the official zoning map of the City. <br /> <br /> <br />
