Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #95 -06- RESOLUTION [SETTING DATE FOR ELECTION FOR PROPOSED CHARTER AMENDMENT WHEREAS, the City received a petition, dated May 23, 1995, for a proposed Charter amendment; and WHEREAS, the proposed Charter amendment reads as follows: Section 14.1 Modification of the MUSA. From time to time the City may wish to expand or modify the area served by sewer and water which is commonly known as the Metropolitan Urban Service Area (MOSA) 14.1.1 Initiation. Modification of the MUSA must be initiated by a 4/5 vote of the City Council. 14.1.2 Evaluation of Proposed Modification. This Chapter is not intended to alter the planning and evaluation process required by law. 14.1.3 Ratification of Proposed Modification. Upon completion of the planning process the proposed modification must be approved by a majority of registered voters prior to its implementation or submission to any;outside regulatory body. AND WHEREAS, City Staff verified the required amount of signatures as registered voters; and WHEREAS, the Ramsey City Staff forwarded such petition/request on to the Ramsey City Charter; and WHEREAS, pursuant to State law, the Ramsey Charter Commission forwarded such petition to the Ramsey City Council; and WHEREA�, the Council must hold an election on the petition within 90 days of receipt, and using the date f May 23, 1995, the election must be on or before August 21, 1995; and WHEREAS, the City has determined the date of August 15, 1995 for the election of the proposed Charter amendment. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council acknowledges receipt of the petition requesting a proposed Charter Amendment. 2) That the Ramsey City Council acknowledges the number of registered voter signatures is sufficient to cause an election.
