The Watershed District Minnesota <br />authority of a under <br />' <br />Statutgs, Chapter 112, to regulate the use and <br />development of the land when one.or more of the <br />' <br />followi;ng conditions exist: <br />1) Lodal government unit exercising planning and zoning <br />authority over land under sections M.S. Sec. 366.10, <br />' <br />2366.19, 394.21, 394.37, or 462.351 to 462.364, does <br />not have a local water management plan approved and <br />adopted in accordance with the requirements of Sec. <br />473.879 or has not adopted the implementation <br />' <br />program described in the plan. <br />' <br />2) Anfapplication to the local government unit for a <br />petmit for the use and development of land, required <br />and limited to, a variance from the adopted local <br />water management plan or implementation plan of the <br />loyal unit. <br />3) Thy local government unit has authorized the <br />Organization to require permits for the use and <br />development of the land. <br />D. Other powers necessary to exercise the authority under <br />Clauses A through C including the power to enter into <br />contracts for the performance of functions with <br />governmental units or persons. <br />a�q <br />A -5 <br />
