I <br /> <br />SubdivisiOn - Design Standards § 9.50.30 <br /> <br />services, subject to review and inspection by the City Engineer. The estimated cost of the <br />improvement, including the administrative charge_s, of the City for supervision and <br />inspection, sl~all be included in the owner/subdivider s contract with the City pursuant to <br />{}9.50.50 Suhtl. 7, and the appropriate financial guarantee in a form acceptable to the City, <br />shall be deposited with the City as required by that section. <br /> ; Subd. 7. Performance contract. Prior to the installation of any <br />required improvements by a subdivider and prior to Council approval of the final plat, the <br />subdivider slj, all enter into a contract with the City, which contract shall require the <br />subdivider toI construct said improvements- at the sole expense of the subdivider and in <br />accordance x~ith City approved constructions plans and specifications and all applicable <br />City standar{s. Said contract shall provide for the supervision of the construction by the <br />City Enginee~ and shall require that the City be reimbursed for all costs incurred by the City <br />for engineering and legal fees and other expenses in connection with the making of such <br />improvement~. The performance of said conwact shall be secured by a financial guarantee, <br />in a form acceptable to the City, as hereinafter set forth. No performance contract or <br />financial sec rt/rr'ity shall be required for any improvement which is not a requirement for <br />approval of ~e final plat. The contract shall also provide that the subdivider give a one (1) <br />year warranty and guarantee to the City from date of acceptance by the City on all <br />improvements constructed on behalf of or dedicated to the City. <br /> <br /> ~ Subd. 8. Construction Plans (All Development Areas). <br />Construction iplans and specification for the required improvements conforming in all <br />respects with ithe code and standards of the City shall be prepared at the expense of the <br />subdivider byla professional engineer registered by the State of Minnesota. Such plans and <br />specificationsishall be approved by the City Engineer and shall become a part of the <br />performance d~ontract. Two (2) prints of said plans and specifications shall be filed with the <br />Administrato~ or designated representative. <br /> [Subd.9. Inspection (Ail Development Areas). All required <br />improvement.~ shall be inspected during the course of construction by the City Engineer and <br />acceptance or,aid improvements by the City shall require the prior written certification by <br />the City Engi.fleer that said improvements have been constructed in compliance with the <br />plans and spe{ifications. <br /> i Subd. 10. Prior Improvements. Improvements which have been <br />completed pribr to application for final plat approval or execution of the performance <br />contract shallibe accepted as equivalent improvements provided the City Engineer shall <br />certify in writin, g that all said improvements conform to City standards. <br /> [Subd.ll. Construction by City. The City shall have the right to <br />install such Of the required improvements as it may elect and upon such terms and <br />conditions as it may deem appropriate under the circumstances. <br /> <br /> i Subd.12. Warranty. The City shall, where appropriate, require a <br />subdivider su~nission of a warranty/maintenance bond in the amount equal to the original <br />cost of the injlprovements which shall be in force for one (1) year following the final <br />acceptance of mY required improvements and shall guarantee satisfactory performance of <br />said improvements. <br /> iSubd.13. As Built Plans. Upon completion of installation of all <br />required improvements, the subdivider shall f'fle with the City a tracing and two (2) copies <br />of plans and specifications showing all improvements as finally constructed and installed. <br />Such as-built_drawings shall be certified to be true and accurate by the registered engineer <br />responsible for the installation of the improvements. <br /> <br /> <br />
