The City agrees to reimburse the <br />School District prior to July 1, 1996 for the cost of constructing one rink, or one half the total <br />project cost, not to exceed $10,000. Any and all change orders or additional costs must be <br />approved in advance by both parties. <br /> <br /> 5. IT IS SPECIFICALLY UNDERSTOOD AND AGREED BY AND BETWEEN <br /> <br />THE PARTIES THAT THE ACTUAL DIVISION OF THE COSTS BETWEEN THE CITY AND <br />THE SCHOOL DISTRICT SHALL BE BASED UPON ACTUAL COSTS. <br /> <br /> 6. Contracting Agency. The School District shall account to the City for the funds <br /> <br />spent on the project. The School District will bill the City, upon 1996 completion, for their <br />contribution of one-half of the actual project costs, not to exceed $10,000. <br /> <br /> 7. .Ownership. In this project, the City is the sole owner of the warming house and <br /> <br />hockey rinks. This agreement does not preclude the City from removing or reducing any or all <br />skating-related facilities at the school. <br /> <br /> 8. Scheduling and Supervision. The School District shall be responsible for all <br /> <br />scheduling during school hours. During nonschool hours, scheduling for activities outside of <br />school buildings shall be the responsibility of the City in coordination with the building principal. <br /> <br /> Supervision shall be the responsibility of the group or groups using the facility. In the <br />event of a conflict in the use of a site by the City or School, the Superintendent or his/her <br />representative and the City Administrator or his/her representative will govern its use. <br /> <br /> 9. Insurance.
