Subdivision <br /> <br />- Design <br /> <br />Standards § 9.50.30 <br /> <br />Subd. <br /> <br /> a. <br /> <br />13. Application to resubdivision. <br /> <br /> In the event of a resubdivision of a parcel for which park <br /> dedication requirements have previously been met, no additional <br /> park dedication requirements shall be imposed as a result of the <br /> resubdivision providing the overall density of development of <br /> the parcel remains the same as the density allowed under the <br /> zoning in effect at the time of the initial subdivision. <br /> <br /> In the event that park ded~.cation requirements were met through <br /> the use of a fee per dwelling unit or based on the value of.the <br /> improvement, additional park dedication shall be made for each <br /> new lot created under resubdivision. <br /> <br /> The park dedication fee shall be based on the specified <br /> contribution per dwelling unit for residential properties resulting <br /> from the resubdivision. <br /> <br />9.50.38 ~Flood Plain Requirements. <br /> <br /> !Subd. 1. Review Criteria: No land shall be subdivided which is <br />unsuitable for the reason of flooding, inadequate drainage, water supply or sewage <br />treatment facilities. All lots within the flood plain districts shall contain a building site at or <br />above the Regulatory Flood Protection Elevation. All subdivisions shall have water and <br />sewage treatment facilities that comply with the provisions of this Section and have road <br />access both t6 the subdivision and to the individual building sites no lower than two feet <br />(2') below th~ Regulatory Flood Protection Elevation. For all subdivisions in the flood <br />plain, the Fl~0odWay and Flood Fringe boundaries, the Regulatory Flood Protection <br />Elevation and the required elevation of all access roads shall be clearly labelled on all <br />required subdl~vision drawings and platting documents. <br /> <br /> : Subd. 2. Floodway/Flood Fringe Determinations in the <br />General Flood Plain District: In the General Flobd Plain District, applicants shall <br />provide the ihformation required in §9.22.06 Subd. 2 to determine the 100 year flood <br />elevation, the Floodway and Flood Fringe .District boundaries and the Regulatory Flood <br />Protection Elevation for the subdivision site. <br /> ' Subd. 3. Removal of Special Flood Hazard Area Designation: <br />The Federal l~mergency Management Agency (FEMA) has established criteria for removing <br />the special fl~¢:~l, hazard area designation for certain structures properly elevated on fill <br />above the 1 ~00-year flood elevation. FEMA's requirements incorporate specific fill <br />compaction ~and side slope protection standards for multi-structure or multi-lot <br />developmentt~. These standards should be investigated prior to the initiation of site <br />preparation it4a change of special flood hazard area designation will be requested. <br /> <br />9.50.39 ,:Violations and penalty. The platting, replatting, subdividing, <br />conveyance Of land or'construction of a sewage disposal system not in accordance with the <br />requirement~ of this section may be enforced by mandamus, injunction or any other <br />appropriate rdmedy in any court of competent jurisdiction. <br /> <br />9.50.40 9.50.40 throught 9.50.49 (reserved). <br /> <br /> <br />
