Add #6 to read: <br />Accept Exhibit as survey. <br /> <br />Execute Resolution #95-06-125 (Bawden/Terry/Holland and LaDue <br />absent) approving the issuance of a variance and declaring terms of <br />same. 'Notify applicant. <br /> <br />Board of Adjustment public heating and regular meeting minutes <br />dated May 24, 1'995 approved. <br /> <br />Findings of Fact - Mike Bahn's request for a CUP to store <br />commercial landscaping equipment: The Planning Commission <br />approved 1-10, and directed Staff to amend the following: (11) <br />"That the proposed use will not be detrimental to persons residing <br />or working in the vicinity of the use or to the public welfare because <br />of noise .... "[delete "traffic"] (12) "That the proposed use will <br />not substantially adversely impair the use, enjoyment or market <br />value of any surrounding properties because of noise .... "[delete <br />"traffic"] (13) "That the proposed use will not be harmonious and <br />in accordance with any specific objectives of the Comprehensive <br />Plan." (14) "That the proposed use will be operated and <br />maintained so as to harmonious and appropriate in appearance with <br />the existing or intended character of the general vicinity and such <br />use will change the essential or intended character of the area. (15) <br />""That the proposed use will increase traffic to and from the <br />Subject Property." (16) "That the proposed use will be disturbing <br />to existing or future neighboring uses . . ." (17) "That the <br />proposed use will not be a substantial improvement to the <br />property . . ." (18) "That the proposed use will not create <br />excessive additional requirements at public cost for public facilities <br />and services and it will not be detrimental to the economic welfare <br />of the community." (19) "That the proposed use will involve the <br />use of equipment that will be detrimental to the serenity and <br />peacefulness of the residential neighborhood..." (20) "That the <br />proposed use will not be consistent with the intent and purposes <br />of Section 9.03.04 (conditional use permits) of the Ramsey City <br />Code." Add a finding to read "That the Planning <br />Commission received into evidence at the pubIic hearing <br />five letters from neighboring residences, two in favor <br />and three opposed to granting a conditional use permit." <br />The Planning Commission voted to recommend that City Council <br />adopt the amended Findings of Fact relating to Mr. Bahn's request <br />for a CUP to store commercial landscaping equipment in a <br />residential district. Forward to City Council. <br /> <br />The Planning Commission voted to recommend that City Council <br />deny Mr. Bahn's request for a CUP, based on the negative <br />Findings of Fact, and grant a ten-month grace period to expire <br />3/31/96 with which to relocate the landscaping operation to an <br />appropriate district. Forward to City Council. <br /> <br /> <br />
