THE ZONING REPORT Page Two <br /> <br />CHECKLIST OF PROVISIONS FOR REGULATING SHORELINES <br /> TO BE INCLUDED IN ZONING AND SUBDIVISION CODES <br /> <br />(Part Two of two parts) <br /> <br />7. ZONING DEVELOPMENT STANDARDS ALONG SHORELINES <br /> <br />A. Loeational and siting criteria. <br /> <br />(a). Survey and recommendation of .the use of all shorelines in the jurisdiction. Many corn- <br /> <br />munities survey all shorelines and coastlines within their jurisdiction and classify them in- <br />to water-oriented zones and buffers by the type of existing developed use and, for unde- <br />veloped segments, for their potential use by water-oriented uses within, th.eir comprehe.nT_ <br />sire plan. Shorelines locally are a finite resource and the survey seeks to optimize their <br />water use potential as a scarce resource. The potential classification of any shoreIine seg- <br />ment for a particular type of use on water is based on the characteristics of the shore- <br />line, its conservation value as a sensitive natural environment and its ability to accommo- <br />date varying intensities of urban and industrial uses. Developed shoreline segments are <br />zoned to recognize existing uses and the predominant character of the shoreline; undevel- <br />oped shoreline segments are zoned as open space holding or agricultural holding zones or <br />as singIe-family or estate zones, pending future rezoning. <br />(b). Criteria for land use development. Shoreline locational criteria for locating or approv- <br />ing proposed land uses on shorelines include: adequate water depth between the proposed <br />facility and any navigational channel, with a preferred location on deepwater to minimize <br />the need for dredging or fill; adequate upland landward of the shoreline to support the <br />land use and its facilities; avoidance of locating on or creating dead-end channels~ canals, <br />ditches, bays and inlets from existing shorelines; difficulty in meeting state water quality <br />standards; ability to adequately contain accidental spills and water contamination; location <br />relative to community potable water supply intakes; ability to provide open and uncovered <br />boat slips and water-dependent facilities over surface waters; reasonable access to natu- <br />rally deep water considering local tides and seasonal water pool levels; and use of existing <br />navigational channels to provide deepwater access to new water-oriented uses. <br />(c). Criteria for shorelines, permanently reserved for environmental protection include: <br />state or federal waters; aquifer recharge areas; marine or estuarine sanctuaries; desig- <br />nated shellfish harvest or fish~ry restoration areas; navigation channels; and road ROW <br />and easements; designated and mapped wetlands; endangered species habitats. <br /> <br />B. Regulation. of setbacks, height and bulk. <br /> <br />(a). Landward of the shoreline; on land. <br /> (i). Shore yard is measured from the defined and designated shoreline.
