subdivided at least ten days prior to the hearing date. Public notice shall <br />consist of a general description of the proposal, the time, date and place of <br />heating. For the purpose of notification, ownership of property within 350 <br />feet shall be determined by records on t-fie in the Anoka County GIS office. <br />In case the plat is disapproved, the subdivider shall be notified of the reason <br />for such action. The notices and publications as required hereunder shall be <br />done by the zoning officer and shall be paid by the subdivider. The <br />Planning Commission shall conduct the hearing on the prelkninary plat and <br />shall make its report to the Council at its next meeting which falls at least 7 <br />days after the planning Commission's public hearing. It shall be the duty of <br />the Planning Commission to determine whether the prelirninary plat <br />conforms with or exceeds the design standards established by this chapter. <br />The decision of the Planning Commission with regard thereto, together with <br />its recommendations, shall be included in its report to the Council. <br /> <br />All engineering considerations presented in the preliminary plat and data <br />furnished by the subdivider, the city staff report and any such repons <br />introduced at any time during the proceedings, shall be resolved prior to the <br />approval of the preliminary plat by the Council. <br /> <br />Section 9.50.04 (Final Plat), Subdivision 1 (Procedure) items a, b, c, d, e, are hereby amended to <br />read as follows: <br /> <br />Following approval of the preliminary by the Council, the zoning officer <br />shall promptly notify the subdivider of said approval. Within one (1) year <br />following approval of the preliminary plat, the subdivider shall ftc six (6) <br />copies of the final plat with the zoning officer. Thereafter, the Council may <br />extend the period upon written application by the subdivider and subject to <br />all applicable performance conditions and requirements, or the Council may <br />require submission of a new application unless the Council finds that <br />substantial activity and investment has occurred in reasonable reliance on the <br />approved application and the subdivider will suffer substantial financial <br />damage as a consequence of a requirement to submit a new application. The <br />final plat shall incorporate all changes required by the Council. <br /> <br />b. Repealed. <br /> <br />The zoning officer shall refer copies of the final plat to the city engineer and <br />the city engineer and the zoning officer shall generate a final plat report. <br /> <br />The final plat report shall be submitted to the Council within 21 dates after <br />the filing of the final plat with the zoning officer. In the final plat report, the <br />city engineer shall state whether the final plat and the improvements <br />conform to the engineering and design standards and specifications of the <br />city. <br /> <br />e. Repealed. <br /> <br />Section 9.50.04 (Final Plat), Subdivision 2 (City Action) items b, c, are hereby amended to read as <br />follows: <br /> <br />Except for Administrative Subdivisions, city staff shall copy the Planning <br />Commission and the Park and Recreation Commission on ali cases and <br />development agreements being forwarded to City Council for final plat <br />approval. <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br /> <br /> <br />
