No fatal plat shall be approved by the Council without first receiving a <br /> ~ report that the improvements described therein, together with the agreement <br /> and documents required under this section, meet the requirements of the <br /> City and adoption of a resolution. <br /> <br />Section 9.50.04 (~inal Plat), Subdivision 3 (Recording) is hereby amended to read as follows: <br />Following approv~ of the final plat by the Council, the zoning officer shall promptly notify the <br />subdivider of saidlapproval and furnish him with a copy of the resolution approving said plat. <br />With two (2) year~ following fatal plat approval, the final plat shall be recorded with the County <br />Recorder or Registrar of Titles of Anoka County. Thereafter, the Council may extend the period <br />upon written appli~,ation by the subdivider and subject to all applicable performance conditions and <br />requirements, or tl/e Council may require submission of a new application unless the Council finds <br />that substantial ac~vity and invesunent has occurred in reasonable reliance on the approved <br />application and th4 subdivider will suffer substantial financial damage as a consequence of a <br />requirement to subfrdt a new application. No plat shall be released for recording at the County until <br />the zoning officer t~as verified that all fees required to be paid to the City in connection with the plat <br />have been paid and the city attorney has stated an opinion of marketable title on the premises <br />involved. <br /> <br />Section 9.50.37 (,Park and Open Space Dedication), Subdivision 5 (Standards for Accepting <br />Dedication of Land for Public Park Purposes) item e, is hereby amended to read as follows: <br /> <br /> e. Grading and utility plans, which may affect or impact the proposed park <br /> dedication, shall be reviewed and approved by the city engineer prior to <br /> : dedication, or at such time as is reasonably determined. <br /> <br />Section 9.50.37 (p~k and Open Space Dedication), Subdivision 9 (Required Improvements) items <br />b, c, are hereby amended to read as follows: <br /> <br />Construct and pave trails which are identified by the city as accessible <br />bikeway/walkway trails in accordance with city standards concurrently with <br />the roads in their developments (i.e., grading with site grading and paving <br />with street or parking lot paving). Grade and provide appropriate surfacing, <br />as recommended by the Park and Recreation Commission and the city <br />engineer of trails identified by the city as horse or wilderness trails. Park <br />dedication credit will be given for construction of the trails(s) and associated <br />improvements at a rate determined by the city engineer. <br /> <br />Complete, construct, and pave walkways which may be required for <br />transportation as a result of the plat in accordance with city standards. Such <br />walkways may be within or abutting residential street right-of-way. No <br />park dedication credit will be given for these connecting links or <br />construction thereof. <br /> <br />Section 9.50.50 (CoOstmction of Improvements), Subdivision 3 (Basic Improvements Installed by <br />Developer) items b !(Stage I Improvements) number 9 (Park and Trail Development) is hereby <br />amended to read as follows: <br /> <br />Park and Trail Development. Develop a park and trail plan prior to <br />the preliminary plat public hearing that is based upon the <br />recommendations of the Park and Recreation Commission. The <br />development agreement shall require this park and trail development <br />to be completed as a Stage I Improvement. <br /> <br /> <br />
