CASE # <br /> <br /> PUB L I C HEARIiX/ G <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />AN OVERSIZED ACCESSORY BUILDING; <br /> CASE OF DAVID AND GALE HENNEK <br />By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from Singco Builders, representing David and Gale Hennek, for <br />a conditional use permit to exceed the accessory building size restrictions established in City <br />Code on the property located at 16100 Wolfram St NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Site Plan <br />c) Cross sections and building elevations for proposed structure <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br />f) Proposed resolution denying conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to ail property owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property is approximately 1.12 acres (49,310 square feet) in size and is located <br />outside the Metropolitan Urban Service Area (MUSA). According to City Code, the property is <br />eligible for 1,664 square feet of accessory building space. The proposed building will be 1,408 <br />square feet (32' x 44') in size. Coupled with the existing garage (704 sq. ft.), the applicant would <br />have 2,112 sq. ft. in accessory building space. This results in an overage of 448 square feet. The <br />applicant would like to exceed the size restriction'in order to construct a detached accessory <br />building that would accommodate the storage of private use vehicles and equipment. <br /> <br />The proposed detached accessory building will be located in the rear yard. The proposed <br />accessory building location will meet and/or exceed all setbacks established in the R-1 Rural <br />Developing District. The applicant has legally obtained an easement from the adjoining property <br />owner to utilize their driveway for access to this proposed structure. <br /> <br />The concrete slab for this proposed structure has already been poured. This work occurred prior <br />to the approval of the Conditional Use Permit and the building permit, and without a required <br />inspection. All work has since been halted until a determination has been made regarding the <br />request fbr a Conditional Use Permit for an oversized accessory structure. <br /> <br />13 <br /> <br /> <br />
