Assistant Public Works Director Olson answered in the affirmative. Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, Strommen, and Zimmerman. Voting No: None. Case #I0: Request for a Conditional Use Permit for an Oversized Accessory Building; Case of Shirley Wilson Community Development Director Frolik advised that the City received an application from Shirley Wilson for a conditional use permit to exceed the accessory building size restrictions established in City Code on the property located at 5391 - 156th Lane NW. The subject property is approximately 0.84 acres in size and is located inside the Metropolitan Urban Service Area (MUSA). Under City Code, parcels between 14,880 sq. ft. and 43,559 sq. ft. can have up to 1,488 square feet of accessory building space. The proposed building will be 1,200 square feet in size. Coupled with the existing garage (528 sq. ft.), the applicant will have 1,728 sq. ft. in accessory buildings. This results in an overage of 240 square feet. The applicant would like to exceed the 1,488 square feet restriction in order to construct a detached accessory building that ~vould accommodate the storage of private use vehicles and equipment. The proposed detached accessory building will be located in the rear yard. The proposed accessory building location will meet and/or exceed all setbacks established in the R-1 MUSA District Bulk Standards. City Code does restrict properties within the MUSA to one driveway and the applicant is aware that a second driveway is prohibited. The Planning Commission held a public hearing and reviewed the request on September 4, 2003. There was no citizen opposition during the public hearing. The Planning Commission recommended the City Council approve the conditional use permit request. Motion by Councilmember Kurak, seconded by Councilmember Strommen, to adopt Resolution #03-09-259 Adopting Findings of Fact #0649 Relating to a Request for a Conditional Use Permit from Shirley Wilson for an Oversized Detached Accessory Building on Properties Located inside the Metropolitan Urban Service Area. Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Strommen, Cook, Pearson, and Zimmerman. Voting No: None. Councilmember Elvig not in attendance during the vote. Motion by Councilmember Kurak, seconded by Councilmember Strommen, to adopt Resolution #03-09-260 Approving the Issuance of a Conditional Use Permit for an Oversized Accessory Building Based on Findings of Fact #0649 and Declaring Terms of Same. Motion cmTied. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Strommen, Cook, Pearson, and Zimmerman. Voting No: None. Councilmember Elvig was not in attendance during the vote.
