Voting No: None. <br /> <br />Case #I0: <br /> <br />Request for a Conditional Use Permit for an Oversized Accessory Building; <br />Case of Shirley Wilson <br /> <br />Community Development Director Frolik advised that the City received an application from <br />Shirley Wilson for a conditional use permit to exceed the accessory building size restrictions <br />established in City Code on the property located at 5391 - 156th Lane NW. The subject property <br />is approximately 0.84 acres in size and is located inside the Metropolitan Urban Service Area <br />(MUSA). Under City Code, parcels between 14,880 sq. ft. and 43,559 sq. ft. can have up to 1,488 <br />square feet of accessory building space. The proposed building will be 1,200 square feet in size. <br />Coupled with the existing garage (528 sq. ft.), the applicant will have 1,728 sq. ft. in accessory <br />buildings. This results in an overage of 240 square feet. The applicant would like to exceed the <br />1,488 square feet restriction in order to construct a detached accessory building that ~vould <br />accommodate the storage of private use vehicles and equipment. The proposed detached <br />accessory building will be located in the rear yard. The proposed accessory building location will <br />meet and/or exceed all setbacks established in the R-1 MUSA District Bulk Standards. City <br />Code does restrict properties within the MUSA to one driveway and the applicant is aware that a <br />second driveway is prohibited. The Planning Commission held a public hearing and reviewed <br />the request on September 4, 2003. There was no citizen opposition during the public hearing. <br />The Planning Commission recommended the City Council approve the conditional use permit <br />request. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Strommen, to adopt Resolution <br />#03-09-259 Adopting Findings of Fact #0649 Relating to a Request for a Conditional Use Permit <br />from Shirley Wilson for an Oversized Detached Accessory Building on Properties Located inside <br />the Metropolitan Urban Service Area. <br /> <br />Motion carried.
