Ms. Pomeroy asked why they did not put a berm or something. She stated she does not believe a
lot of thought went into this design. She asked where the expansion room is for Highway 47.

A1 Kempf, 15220: St. Francis Boulevard indicated he is the neighbor to the south, and has not
objection to the change. He thinks this is a lot better design than the original building. He stated
as far as Highway 47, you can drive down and look on the decks of other projects already. He
thinks a three-story would be a benefit to the houses to the west, and would be the same height as
them.

Chairperson Nixt asked if he was okay with a deck looking over his yard.

Mr. Kempf stated, he has no problem with that, noting most of the yard work would be close to
the fence anyway, i

Motion by Commissioner Johnson, seconded by Chairperson Nixt to recommend that the City
Council approve the revised site plan for Alpine Meadows contingent upon compliance with City
Staff Review Letter dated August 29, 2003.

Chairperson Nixt.indicated he tends to concur that the resulting changes are good, but he is
sympathetic to Ms. Pomeroy's comments. He stated the Planning Commission will always look
closely at these, and he does not want frivolous changes made for no reason.

Commissioner Johnson stated he appreciates the concerns raised, but he is okay with the
changes, and is willing to accept that the change in the plans was a mistake rather than an attempt
to circumvent the Planning Commission and City Council. He feels it is always wise for those in
this business to make changes to accommodate the market, and he believes it was an honest
mistake.

Commissioner Brauer asked how they prevent this from happening.

Commissioner Johnson stated he feels the City sent a strong message to developers by stopping
the construction for a month.

Commissioner Brauer suggested writing stronger language in the developer's agreement to
prevent this type oi'thing from happening.

Chairperson Nixt stated after looking at the rendering and the revised sketch, he agrees this
design is much better, which is a significant incentive to approve.

Commissioner Shepherd agreed the design is better, but also that they do not want builders to
think they can circumvent the process. She stated she does not see this one as an issue.

Commissioner Van Scoy asked if they received a building permit for this plan.

Planning Commission/September 4, 2003
