Commissioner Johnson stated they would also need findings for less than 60% on the east side.

Principal Planner Trudgeon indicated he thought the CUP would be sufficient to deal with that
when they have the public hearing at the next meeting.

Mr. Thorson stated Staff also wanted to see more recessed windows, which they can achieve on
the north side, however it is difficult on the other side because of the pre-fabricated panels. They
were thinking of using eyebrow awnings on the east and west, which gives the shadow lines Staff
is looking for.

Chairperson Nixt indicated he would be okay with that option. He asked about the landscape
plans.

Assistant Community Development Director Trudgeon indicated the landscape requirements
need some re-work in general.

Mr. Thorson indicated they could not recess the parking as was suggested, but are looking at
some hedging to address the screening requirements. He stated nothing else from the Staff
Review Letter is an issue, and they would be happy to work with staff on the architectural
elements.

Assistant Community Development Director Trudgeon indicated they need to state that
educational uses are different and allowed to have these deviations, or they need to create a very
specific district, such as TC-3a, to include only educational facilities.

Commissioner Watson indicated they need to be careful what is considered an educational
facility, or beauty schools or daycare centers will want these exceptions also. He stated
educational facility might be too broad a term.

Assistant Community Development Director Trudgeon noted they still need more information on
the park. He stated there might be a problem with PACT using the space exclusively and the
City maintaining it. They have a commitment to have a decision and plan from RTC in 60 days
to see how it will work. He indicated the developer would want credit for the park dedication,
but without knowing how much the school will use it, it has not been determined how much
credit will be given, so they have a 60 day window to work it out.

Motion by Chairperson Nixt, seconded by Commissioner Johnson to recommend to the City
Council approval of the proposed site plan for the PACT Charter School contingent on the
following:
a) Compliance with City Staff Review Letter dated September 12, 2003, with modification to

reflect the comments regarding windows.
b) Approval of the final plat of Town Center Addition.
c) The Applicant entering into a Development Agreement with the City.
d) Final approval of the Town Center Zoning District.

Planning Commission/September 15, 2003
