CASE <br /> <br />REQUEST FOR REVISED PRELIMINARY PLAT OF CHESTNUT HILL; <br />CASE OF JOHN PETERSON, GOOD VALUE HOMES <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On Ma3' 22, i990, the Ramsey City Council granted preliminary plat approval to Chestnut Hill. <br />The final pha~e of Chestnut Hill included an extension of 145th Lane to the west boundary of the <br />plat that woul~ mm north and connect to the future Sunwood Drive. The extension of 145th Lane <br />included crossing a wetland. There was also a preliminary plat revision approved in 1993, but it <br />did not affect the alignment of the western portion of 145th Lane. <br /> <br />Since prelimir~ary plat approval in 1990, wetland regulations have become more stringent and it is <br />no longer po~;sible to construct roads through wetlands, even with mitigation, if there is an <br />alternative rotite. On May 17, 1994, the developer submitted a request for revised preliminmj, plat <br />to end the wes{em portion of 145th Lane in a cul-de-sac with no extension through the wetland and <br />no connection~with Sunwood Drive. <br /> <br />On June 6, 1994, the Planning Commission conducted a public hearing regarding the proposed <br />revision to the~approved preliminary plat to allow this final phase of Chestnut Hill to be developed <br />with the west~.rn portion of ]45th Lane ending in a cul-de-sac. Residents of Hunter's Hill were <br />present at the !~ublic hearing and expressed dissatisfaction with the potential loss of another outer <br />to a collector s~reet by the elimination of 145th Lane intersecting Sunwood Drive. The developer, <br />John Peterson; requested that the public hearing be continued and any action tabled to allow his <br />en~neers time_to review the plat to determine whether it is possible to design 145th as a through <br />street to Sunwood Drive without any impact to the wetland..-' <br /> <br />On July 5, 19~4, Good Value Homes presented the Planning Commission with a second design <br />proposal for Chestnut Hill 5th Addition that extends 145th Lane as a through street to Sunwood <br />Dm, e with miriimal impact to the wetland. The newly proposed alignment of 145th resulted in a <br />remnant of property on the west side of the street that at the time was proposed to be conveyed to <br />Mr. Deemer, the adjacent property owner to the west, for purposes of platting. The Planning <br />Commission recommended revised preliminary plat approval contingent upon a recommendation <br />from the Park and Recreation Commission as to whether or not a trail connection is desireable <br />between Hunter's Hill Park and the Sunwood Drive Trail. <br /> <br />Subsequent to [he Planning Commission meeting on July 5, 1994, Good Value Homes and Mr. <br />Deemer entere~ into a purchase agreement wherein Good Value would purchase a sufficient <br />amount of property from Mr. Deemer to combine with their remnant on the west side of 145th. <br />This acquisition of property would enable Good Value Homes to create 3 more lots on the west <br />side of ]45th without ]xir. Deemer's participation in the plat. <br /> <br />At their meeting on July ]4, 1994, the Park and Recreation Commission recommended that with <br />the revised preliminary plat, the park dedication requirement for Chestnut Hill be amended to <br />require a trail link in the 5th Addition that connects Hunter's .Hill Park with the Sunwood Drive <br />mail. At the dat~ of this writing, Staff had not been provided With another revision of the revised <br />preliminary plai that indicates the inclusion of the trail, but the Developer has a~eed to provide <br />same. <br /> <br /> <br />
