CASE <br /> <br />ADOPT PROPOSED CHARTER AMENDMENT ORDINANCE <br /> By: William K. Goodrich, City Attorney <br /> <br />At the July 26, 1994 meeting, City Council introduced an ordinance, proposed by the <br />Charter Co.mmission, repealing Section 4.2.1 of the Ramsey City Charter. The Charter <br />Commission proposed this amendment based upon discussion with the Anorney General's <br />office and ,the City Anorney's advice that this would most likely be considered <br />unconstitutional. This section reads as follows: <br /> <br />Any applicant currently holding an elected office in the city, and seeking <br />election to an office different from tile office he/she currently holds and <br />subject to the limitations prescribed in section 2.4., shall be required to <br />submit his/her resignation from his/her current office upon filing his/her <br />· affidavit. The affidavit, resignation and fees shall be submitted to the clerk- <br />administrator no earlier than fifty-six days nor later than forty-two days <br />before any municipal election. The applicant's resignation from office shall <br />become effective after certification of the election results. <br /> <br />At the July :26 meeting, a public hearing was scheduled for tonight, August 9, 1994, at <br />which timeiCouncil may formally adopt this ordinance. The public hearing notice and <br />ordinance was published in the Anoka Union (the City's official newspaper) on Friday, <br />July 29 and again on Friday, August 5, 1994.
