CASE

ADOPT PROPOSED CHARTER AMENDMENT ORDINANCE
By: William K. Goodrich, City Attorney

At the July 26, 1994 meeting, City Council introduced an ordinance, proposed by the
Charter Co.mmission, repealing Section 4.2.1 of the Ramsey City Charter. The Charter
Commission proposed this amendment based upon discussion with the Anorney General's
office and ,the City Anorney's advice that this would most likely be considered
unconstitutional. This section reads as follows:

Any applicant currently holding an elected office in the city, and seeking
election to an office different from tile office he/she currently holds and
subject to the limitations prescribed in section 2.4., shall be required to
submit his/her resignation from his/her current office upon filing his/her
· affidavit. The affidavit, resignation and fees shall be submitted to the clerk-
administrator no earlier than fifty-six days nor later than forty-two days
before any municipal election. The applicant's resignation from office shall
become effective after certification of the election results.

At the July :26 meeting, a public hearing was scheduled for tonight, August 9, 1994, at
which timeiCouncil may formally adopt this ordinance. The public hearing notice and
ordinance was published in the Anoka Union (the City's official newspaper) on Friday,
July 29 and again on Friday, August 5, 1994. If adopted, this ordinance would become
effective November 11, 1994.

Council Action:

Motion to adopt Ordinance #94-XX which is an ordinance repealing Section 4.2.1 of the
City Charter.

Reviewed by:

City Attorney
City Administrator

CC: 08/09/94
/jmt
