12.2 The Contractor will not load nor permit any part of the structure to be loaded with weights <br />that will endanger the structure, nor will he subject any part of the Work to stresses or pressures that <br />will endanger it. <br />ARTICLE 13. Engineer's Status During Construction <br />13.1 The Engineer shall be the Owner's representative during the construction period. All <br />instructions of the Owner to the Contractor shall be issued through the Engineer. The duties and <br />responsibilities and the limitations of authority of the Engineer as the Owner's representative during <br />construction are set forth in all Articles of these General Conditions and shall not be extended without <br />written consent of the Owner and the Engineer. <br />13.2 The Engineer will make regular visits to the Work site to observe the progress and quality of <br />the executed Work and to determine, in general, if the Work is proceeding in accordance with the <br />Contract Documents. The Engineer's efforts will be directed toward providing assurance for the <br />Owner that the completed Project will conform to the requirements of the Contract Documents. On <br />the basis of the Engineer's on -site observations as an experienced and qualified design professional, <br />he will advise the Owner as to the progress of the Work and the performance of the Contractor. <br />13.3 The Engineer will have authority to disapprove of or reject Work which is defective; i.e., is <br />unsatisfactory, faulty or defective, or does not conform to the requirements of the Contract <br />Documents or does not meet the requirements of any inspection, test or approval. The Engineer will <br />also have authority to require special inspection or testing of the Work whether or not the Work is <br />fabricated, installed or completed. <br />13.4 The Engineer will provide one or more full -time resident Project Representatives to assist the <br />Engineer in carrying out his responsibilities at the Work site during construction activity. The duties, <br />responsibilities and limitations of authority of any such resident project representative shall be as set <br />forth in the pre - construction meeting held by the Engineer. <br />13.5 Neither the Engineer's authority to act under this article nor any decision made by him in good <br />faith either to exercise or not exercise such authority shall give rise to any duty or responsibility of <br />the Engineer to the Contractor, any Subcontractor, any of their agents or employees or any other <br />person performing any of the Work. <br />ARTICLE 14. Engineer's Interpretations and Decisions <br />14.1 The Engineer will issue with reasonable promptness such written clarifications or <br />interpretations to be consistent with or reasonably inferable from the overall intent of the Contract <br />Documents. <br />14.2 The Engineer will be the initial interpreter of the terms and conditions of the Contract <br />Documents and the judge of the performance thereunder. In his capacity as interpreter and judge, the <br />Engineer will exercise his best efforts to insure faithful performance by the Contractor. The Engineer <br />will not show partiality and shall not be liable for the result of any interpretation or decision rendered <br />in good faith.
