The Board of <br />Adjustment approved 1, and 3-6, and directed Staff to amend the <br />following: (2) '"The accessory structure shall maintain a minimum <br />distance of two hundred (200) feet from the property line..." <br /> <br />Execute Resolution #94-03-052 (Thorud/Holland/Deemer <br />Abstained) approving the issuance of a variance to Ben Deemer at <br />14501 Sunfish Lake Boulevard N.W. and declaring terms of same, <br />as amended. <br /> <br />Execute Resolution #94-03-057 (Peterson/Zimmerman/ <br />Hardin Abstain) adopting Findings of Fact #0358, as amended, <br />relating to William Dubats' request for a conditional use permit <br />to establish and operate self-service storage facilities on Lot 3, <br />Block 3, Riverside West. Amend Findings of Fact as <br />follows: #20 "That the proposed use will create <br />additional requirements (delete the word not and the <br />word excessive). <br /> <br />Execute Resolution #94-03-058 (Beyer/Peterson/Hardin <br />Abstain) approving the issuance of a conditional use permit to <br />William Dubats and declaring terms of same, contingent upon <br />certification of the variance to impervious surface area <br />restrictions by the Commissioner of DNR. <br /> <br />Make the following amendments to the development Permit for <br />Bill Dubats: #5 should rad as follows: TREE SCREENING <br />CONSIDERATIONS. The Permittee shall plant that amount of <br />trees required by City Code with a minimum 1 inch trunk <br />diameter along the south property...In the second paragraph <br />of #5: It is herein agreed that the Permittee shall provide a) <br />written verification by the City that the trees have been installed <br />in accordance with the pre-approved Landscape Plan; b) <br />presentation of documents by the Permittee to support that the <br />Site is current on all property taxes, assessments and all City <br />fees and charges; and c) the Permittee supplying the City with a <br />maintenance guarantee to ensure the survival of the plantings. <br /> <br />Council approved the site plan for self-service storage facilities <br />on Lot 3, Block 3, Riverside West, with amendments, and <br />contingent upon DNR certification of the variance to impervious <br />surface area and the applicant'".entering into a development permit <br />agreement with the City. Execute the Development Permit. <br /> <br />Council tabled sketch plan approval for Town Houses of Rum <br />River Hills until Staff could set up guidelines for making <br />exceptions to the 4 in 40 policy. Council also directed that the <br />Planning Commission should be involved in this process. <br /> <br /> <br />
