I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />10. <br /> <br />That on ~ay 24, 1994, the Ramsey City Council advised the Applicant to approach the <br />Planning ~2ommission for a variance to cut-de-sac length in accordance with Section <br />9.50.30 (Subdivision Design Standards), Subsection 9.50.08 (Variances). <br /> <br />11. <br /> <br />That on JUne 6, 1994, the Planning Commission was advised that DNR had denied the <br />permit request to fill a portion of Wetland/14/2-114P in order to construct Krypton Street <br />N.W. as a!through street. <br /> <br />12. <br /> <br />That on Ju, ne 6, t994, the Planning Commission was also informed that bridging Wetland <br />#2-114P i}; a second alternative to constructing Krypton Street N.W. as a through street, <br />but it could adversely impact the City's opportunity to obtain a permit to cross the wetlands <br />in that same proximity in order to extend Sunwood Drive as planned. <br /> <br />13. <br /> <br />That the ~pplicant has stated that bridging the wetland is cost prohibitive for the creation of <br />13 lots. <br /> <br />14. <br /> <br />That the special condition causing the undue hardship is the fact that the Subject Property is <br />surrounde0 on three sides by wetland and this condition does not result from the actions of <br />the Appliclmt. <br /> <br />15. <br /> <br />That by reltson of physical conditions, namely Wetland #2-114P and County Ditch No. 43, <br />strict com~Iiance with the requirements of cul-de-sac lengths will/will not cause exceptional <br />and undue Ihardship to the development of the Subject Property. <br /> <br />16. <br /> <br />That if granted, the variance will/will not adversely affect the spirit and intent of the <br />Ramsey Zoning Chapter and Subdivision Design Standards. <br /> <br />17. <br /> <br />18. <br /> <br />The motion for th~: adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said re~olurion was declared duly adopted by the Ramsey City Council this the __ <br />of ,1994. , <br /> <br /> Chairman <br />ATTEST: <br /> <br />CiD' Administrator <br /> <br /> <br />
