10. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that Anoka County constructed <br />improvements to C.S.A.H. #56 that included acquisition of additional fight-of-way and <br />realignment of the roadway which diminished the front yard of the subject property. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That similar variances have been granted by the City in the Residential District. <br /> <br />That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />That such variance is/is not necessary for the preservation of a substantial property right <br />similar to that possessed by other properties in the R- 1 Rural Residential District. <br /> <br />That if gra_nted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other owners of lands, su'ucmres or buildings in the same district. <br /> <br />That if granted, the variance will/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R-1 Rural Residential District. <br /> <br />That if granted, the variance will/will not substantially increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />That the applied for use is/is not an expansion of the need for public services on the <br />property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br />~ da3' of ,1994. <br /> <br /> Chairperson <br />ATTEST: <br /> <br />Ci~ Administrator <br /> <br /> <br />
