Mr. Hartley indicated that the proposed ordinance could be modified with a distance requirement of <br />1,000' if the Planning and Zoning Commission was willing to take the risk that the ordinance <br />would be stricken by the courts. <br /> <br />Mr. Goodrich noted that in the Renton, Washington case, they did go with a 1,000' requirement, <br />but they still met the 5% of the gross area of the city for adult uses. <br /> <br />Chairman Zimmerman noted that Mr. Ted Bundy, convicted and executed sex offender, admitted <br />that he was exposed to pornographic material at an early age which affected his mind and led to his <br />crimes. <br /> <br />Commissioner Bawden arrived at 8:10 p.m. <br /> <br />The consensus of the Commission was to amend Item #12 of the proposed Findings of Fact to <br />begin the finding with the phrase "Based on studies reviewed .... ". <br /> <br />The consensus of the Commission was to amend Item #13 of the proposed Findings of Fact to <br />reference a distance of 330' to 1,000' versus 1 to 3 blocks. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend Item #14 of <br />the proposed Findings of Fact to begin with the phrase "Based upon studies reviewed and public <br />hearings conducted by the Ramsey Planning and Zoning Commission...". <br /> <br />Motion carried. Voting Yes: Chairman Gerald Zimmerman, Commissioners LaDue, Deemer, <br />Thorud and Bawden. Voting No: None. Absent: Commissioners Hendriksen and Terry. <br /> <br />Motion by Commissioner Bawden and seconded by Chairman Zimmerman to amend Item #15 of <br />the proposed Findings of Fact to delete the word "strip" from the phrase "commercial strip <br />development". <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Deemer, Thorud and <br />Bawden. Voting No: None. Absent: Commissioners Hendriksen and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to add a finding to the <br />proposed Findings of Fact indicating that the Planning and Zoning Commission has received and <br />reviewed a planning report dated September 20, 1990 entitled Adult Uses prepared by Northwest <br />Associated Consultants, Inc. <br /> <br />Further Discussion: Chairman Zimmerman noted that as a result of discussions with the Economic <br />Development Commission, it was determined that in the proposed ordinance amendment, exterior <br />storage as an accessory use should be permitted without a conditional use permit because under the <br />current ordinances, a CUP is not required for exterior storage as an accessory use. Mr. Harfley <br />stated that he will make those modifications to the proposed ordinance. Chairman Zimmerman <br />noted that these modifications should apply to the industrial district, the rural industrial district and <br />the business warehouse district. Mr. Hartley requested clarification on the modification. Chairman <br />Zimmerman indicated that in the business warehouse district, the rural industrial district and the <br />industrial district, exterior storage should be permitted as an accessory use.
