Mr. Raatikka stated that a clause in the City Ordinance states that a final slope cannot exceed 12%. <br />Four to one is an acceptable slope. <br /> <br />Commissioner Deemer asked how a permit would be worded to allow a steeper slope. <br /> <br />Mr. Raatikka answered that a variance would have to be applied for. <br /> <br />Commissioner Deemer asked how to safeguard this slope if Mr. Bridwell wants a variance. <br /> <br />Mr. Raatikka replied that Mr. Bridwell would have to vegetate it or use fiber blankets, etc. <br /> <br />Acting Chairman Hendriksen requested the aerial photograph of the subject section which Ms. <br />Frolik provided. A discussion ensued regarding the slope with the Planning and Zoning <br />Commission and concerned citizens. <br /> <br />Acting Chairman Hendriksen asked if the Commission felt they should proceed with the findings <br />of fact or if they should wait until all request have been met. <br /> <br />It was the consensus of the Commission to proceed with the findings of fact and review the <br />language of each fact individually. <br /> <br />Mr. Raatikka stated that a new plan regarding the restoration will be submitted. <br /> <br />Acting Chairman Hendriksen proceeded to review the findings of fact with the Commission. It <br />was the consensus of the Commission that facts numbered one through eight should read as <br />presented. Regarding fact//9, Acting Chairman Hendriksen inquired of Mr. Raatikka if the two <br />months referred to the next two months or if it means two months in the spring and also the <br />statement regarding the restoration to be completed in the spring, meaning which month. <br /> <br />Mr. Raatikka answered that the two months refers to December and January and Spring, 1991 <br />refers to the month of May. <br /> <br />The language remains as is in facts 4/9 through//14. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend that city <br />Council adopt the findings of fact relating to Mr. Geoffrey Bridwell's request for a conditional use <br />permit to mine and excavate materials from Lot 3, Block 1, Lutz Ramsey Acres. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Deemer, Bawden, <br />LaDue, Terry and Thorud. Voting No: None. Absent: Chairman Zimmerman. <br /> <br />Acting Chairman Hendriksen proceeded to review the items individually listed in the proposed <br />conditional use permit. <br /> <br />Item 4/1 should be left as is. <br /> <br />Discussion ensued regarding item #2 as to whether or not a clause should be added regarding a <br />variance. It was decided to leave it as is as the 12% grade slope is in conformance with the City <br />Ordinance. <br /> <br />Regarding item #3, Mr. Raatikka stated that Mr. Bridwell will bring in a new plan with regard to <br />the number of cubic yards allowed. <br /> <br />Planning & Zoning/December 4, 1990 <br /> Page 4 of 12 <br /> <br /> <br />
