Absent: Chairman Zimmerman. <br /> <br />When questioned about Mr. Bridwell having to carry a bond, Mr. Raatikka answered that the <br />contractor will provide insurance so Mr. Bridwell doesn't actually have to. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend that <br />City Council approve Mr. Geoffrey Bridwell's request, as amended, for a conditional use permit to <br />mine and excavate materials from Lot 3, Block 1, Lutz Ramsey Acres. <br /> <br />Motion carried. Absent: Chairman Zimmerman. <br /> <br />The recommendation will go to City Council Tuesday, December 11, 1990. <br /> <br />Acting Chairman Hendriksen recessed the Planning and Zoning Commission meeting at 9:00 p.m. <br /> <br />Acting Chairman Hendriksen called the Planning and Zoning Commission meeting back to order at <br />9:12 p.m. <br /> <br />Case #2: Request for a conditional use permit to erect and maintain a HAM <br /> radio tower; Case of Howard Rohs and James Monson <br /> <br />Zoning Administrator Sylvia Frolik stated that Mr. Monson is proposing to buy Mr. Rohs property <br />at 15705 Traprock Street N.W. contingent upon obtaining a conditional use permit from the City to <br />erect and maintain a HAM radio tower. She included a description of the tower which would be 80 <br />feet tall and would have either a vertical or horizontal antenna attached to it. It will be aluminum <br />with stainless steel fittings. The tower would be located five to twenty feet from the home either to <br />the east (rear yard) or to the south (side yard) and would be visible above the home and trees. Ms. <br />Frolik stated that the tower is proposed to be located approximately 8,000 feet from the end of the <br />runway at Gateway North Industrial Airport and that at the present time the City has no zoning <br />regulations or Airport Safety Zoning in place to establish height limits. However, Mr. Monson has <br />filed a Notice of Proposed Construction with FAA in the event he is granted the conditional use <br />permit. FAA will then decide if the tower can be constructed as proposed or if any dimensions, <br />etc. need to be changed. Ms. Frolik reviewed some of the concerns of the neighbors. In addition <br />to the visibility of the tower, another concern is interruption of electrical reception in the area. Mr. <br />Monson will have to be FCC licensed, however, that does not guarantee the absence of electrical <br />interference. She spoke with a representative of FCC and was told that electrical interference is <br />more likely when area residents possess electrical equipment of a lesser quality or equipment that is <br />improperly maintained. Another concern would be that in the event of a collapse, the tower <br />structure would collapse entirely on-site and not present a danger to neighboring property and <br />structures. She informed the Commission and the residents that when she contacted Mr. William <br />Cross of the FCC in Washington, D.C., he indicated that requiring a tower setback from property <br />lines equal to 30% of the tower height is sufficient. <br /> <br />Mr. James Monson stated that in the past couple months he's become attached to the area and to the <br />neighbors. He expressed his desire to answer all questions and address all concerns plus submit a <br />revised plan to his "would-be" neighbors. With regard to interference, he stated he's been licensed <br />for over 10 years as a HAM radio operator and has received only one complaint from FCC, which <br />he corrected immediately, therefore, his record is considered excellent. With regard to appearance <br />of the neighborhood with the tower, he stated that the beauty of the neighborhood is also extremely <br />important to him. He explained that he previously lived in a very elite village (Silver Lake Village, <br />Ohio), and with the trees for cover, his tower was virtually not visible.
