MPCA and EPA are in the process of revising their guidelines and Ramsey's ordinance would then be subject to amendment within one year. Of more concern to the City is toxic emissions and anything the City would have written into the ordinance along those lines would have been the burden of the City to prove if challenged. It was thought by Staff that a better option would be to adopt a generalized ordinance which is before the Commission now for review. This particular ordinance could be challenged by someone seriously considering placing an incinerator in Ramsey and if it were striken down, the City would still have the conditional use process to fall back on. In addition, the ordinance as written would discourage somebody that is taking a fn-st look at a number of communities for placement of an incinerator. Basically, the ordinance indicates that there is no burning of solid, hazardous, medical or special wastes by incinerator in Ramsey. Commissioner Deemer stated that he does not agree in theory with an ordinance that most likely will not stand up in court. Commissioner Deemer stated that one loop hole in the ordinance is that it exempts existing incinerators. Mr. Otto stated that it may be possible for the proposed ordinance to prohibit existing incinerators from burning contract waste. In addition, with the proposed standards EPA is working on, 85% of the incinerators in the Country are probably going to have to be retrofitted. Commissioner Deemer suggested that the City have a separate ordinance requiting existing incinerators to be monitored and thereby create an economic disincentive to their continued use. Motion by Commissioner Bawden and seconded by Commissioner LaDue to recommend that City Council adopt the proposed amendment to the Zoning Ordinance regarding waste incineration. Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Bawden and Deemer. Voting No: None. Absent: Commissioners Terry and Shumway. Required Information On Certificate Of Survey - The Commission proceeded to review what is proposed to be required on certificates of survey in the MUSA area and in the Rural aarea. Chairman Zimmerman suggested that City Staff obtain price quotes from surveyors regarding the cost to provide what is proposed to be required on certificates of survey. Chairman Zimmerman suggested that the draft Information Required On Certificate Of Survey be rewritten to categorize the requirements, and thereby simplify the process for the property owners by indicating which categories are to be addressed in each particular case.
