Mark Banwart replied that the utility laterals are paid for by the developer; if it is <br />economically feasible, it has been the City's policy to extend trunk lines as a tax increment <br />financing project; if the economics are not there, it cannot be financed as a tax increment <br />project; if it can't be financed with tax increment financing, it is safe to say it is not feasible <br />for the developer to underwrite the cost. Any properties adjacent to sewer and water lines <br />will be required to hook-up to the services within 2 years. <br /> <br />Janet Bernstrom - Stated that when an apartment complex was being considered for the <br />subject property, it was stated at meetings that commercial uses require larger pipe sizing <br />than residential uses, and on that basis nearby residents would be on a deferred status with <br />respect to hooking up to the system. <br /> <br />Mark Banwart stated that when trunk lines are developed, they are sized to facilitate the <br />entire benefitting area. The two year hook-up requirement when sewer becomes available <br />is a factor that is being mandated to the City by Metro Council. Mr. Banwart stated that <br />there are definitions being developed by the City that will specifically define when sewer is <br />considered to be 'available'. <br /> <br />Robert Bernstrom - Inquired if the City has to replace the B-1 and R-3U areas if Fleischer's <br />2nd Addition is rezoned to R-1U. <br /> <br />Mark Banwart replied that the City does not have to replace any zones that are rezoned. <br /> <br />Janet Bemstrom - Stated that the City will be losing commercial tax base if it continues to · <br />rezone B- 1 and R-3 without replacing it. <br /> <br />Marilyn Katnis - 14660 St. Francis Blvd. N.W. - Inquired why the area is developing at <br />urban densities and why that City can't remain rural. <br /> <br />Mark Banwart replied that the subject area is within the designated MUSA area which <br />means that Metro Council and the Metro Waste Control Commission has authorized the <br />potential development of urban sewer and water lots in this area. Mark Banwart stated that <br />it takes over 5 square miles of rural development to end up with a value equivalent to 400 <br />acres of urban development; the reality is that if the community is going to develop as a full- <br />fledged city, high density urban development is more valuable than rural development. <br /> <br />Janet Bemstrom - Inquired as to when the developer will making a determination regarding <br />whether or not the sewer and water project is economically feasible. <br /> <br />Mark Banwart replied that the developer will make a determination regarding the economic <br />feasibility of the project based on the feasibility study or the tax increment financing <br />process. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to enter into the <br />public hearing record a letter received from Anna Boe dated September 27, 1989 regarding <br />questions and concerns with the proposed Fleischer's 2nd Addition. <br /> <br />Planning and Zoning Commission Public Hearing/October 3, 1989 <br /> Page 2 of 3 <br /> <br /> <br />
