Case #13: Feasibility Report For Street Lights For Rivlyn Avenue <br /> Improvement Project #90-18: <br /> <br />Mr. Raatikka stated that he has prepared a feasibility study for the installation of 3 street <br />lights on Rivlyn Avenue. The estimated total cost for the project is $3600; the per unit cost <br />is estimated at $189.47, amortized over a 10 year period for $29.52 per unit per year. City <br />Staff is proposing to charge the benefitting properties $5/quarter for the operation of the <br />lights. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to adopt <br />Resolution 4/90-05-140 receiving report and calling a heating on June 12, 1990 for <br />Improvement Project//90-18 (street lights for Rivlyn Avenue). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #14: <br /> <br />Adopt Ordinance Placing A Moratorium On The Siting Of Adult <br />Bookstores In The City Of Ramsey: <br /> <br />City Attomey Goodrich stated that the proposed ordinance to place a moratorium on the <br />siting of adult bookstores was introduced on April 24 and is essentially the same as the <br />ordinance that was adopted on an emergency basis. <br /> <br />Mr. Goodrich stated that he did appear in court today regarding the owner of the <br />bookstore's request for a temporary restraining order relating to Ramsey's moratorium on <br />the siting of adult bookstores. The judge listened to both sides and indicated making a <br />decision sometime in the near future. The plaintiff's attorney argued that freedom of <br />expression cannot be limited, even temporarily; the City argued that it has that authority by <br />State statute. The judge did ask what efforts Ramsey is making towards planning for adult <br />entertainment centers and the City indicated that it is researching and considering hiring a <br />planning consultant to provide advice as to the secondary affects of adult entertainment. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adopt <br />Ordinance 4/90-8 placing a moratorium on the siting of adult bookstores in the City of <br />Ramsey. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca to authorize <br />City Staff to authorize an expenditure of $1500 to hire a planner to assist the City in issues <br />relating to adult entertainment centers. Further, that continued services by the Planner <br />beyond $1500 must be approved by City Council. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson.
