Councilmember Peterson requested that City Engineer Raatikka and Community <br />Development Director Banwart be provided with a copy of the statements made this <br />evening and those concerns listed in the petition in order that they may conduct a thorough <br />follow-up investigation, respond to the citizens and report back to City Council. <br /> <br />Jean Schlueter noted that the previous motions requires that Lot 1 be restored; inquired if <br />the lot will then be turned over to the developer for future development with the City <br />retaining a strip of drainage easement along the northern boundary. <br /> <br />Councilmember Peterson noted that Lot 1 would have been turned over to the developer if <br />the change order to amend the drainage plan was approved. <br /> <br />For the record, Councilmember Peterson stated that Lot 1, Block 5, Rum Acres Estates will <br />be restored as close as possible to it's previous natural state and remain as a drainage lot for <br />Rum Acres Estates. <br /> <br />Dick Knutson - BLH Development Company - Stated that he will not pay to restore Lot 1, <br />Block 5, Rum Acres Estates. Mr. Knutson stated that he got approval from the City for a <br />storm sewer to the river and it is not his intention to drain to Lot 1 and back to Juniper <br />Woods. Mr. Knutson stated that it would be pound foolish not to put in a culvert in that <br />would drain Rum Acres at some future time if they would need it. If Lot 1 is restored it <br />might not function and then Rum Acres will need a storm sewer to the river. The approved <br />preliminary plat for Juniper Woods showed a storm sewer going to the river;, Rum Acres' <br />drainage would have been taken care forever at no charge to the residents of that <br />neighborhood. The construction of a retention basin on Lot 1 came after the fact. Mr. <br />Knutson then spoke about the relationship between Juniper Woods development and the <br />residents of Rum Acres. Mr. Knutson stated that last year the surveying stakes had to be <br />continuously replaced; early this spring, the foreman on the job chased away 3 kids that <br />were pulling stakes; one of the kids was traced to a home in Rum Acres; when confronted, <br />the homeowner stated that the children were home alone and that the matter of stakes being <br />destroyed was between the developers of Juniper Woods and the police. Following that <br />incident, there was very little disturbance. One Saturday, 3 boys set the woods on fh'e; that <br />fire had the potential to do another $70,000 worth of damage to Juniper Woods. Mr. <br />Knutson stated that the animosity directed at him by the residents of Rum Acres has <br />evidently gone to the supper table and the families. Mr. Knutson stated that he has met <br />with the Police Chief and requested an investigation. Mr. Knutson stated that he has <br />accepted being called names by fine people and tried to be a good neighbor and the time has <br />come to call a pact. Mr. Knutson stated that in 37 years of development, he has only <br />encountered situations like this 3 times; in two of the incidents, the harassment stopped <br />immediately but in this situation it continues. Mr. Knutson stated that if the harassment <br />does not stop, he will prosecute to the full intent of the law. <br /> <br />Dorothy Stadfelt - Stated that she feels badly that the harassment is happening but the <br />persons at her dinner table know that City Hall is where matters like this are taken care of. <br />Dorothy indicated that she does not know who started the fire. Dorothy stated that just like <br />Mr. Knutson, the residents of Rum Acres are concerned that they have been violated and <br />she is sorry that the two sides don't get along. <br /> <br />City Council/May 22, 1990 <br />Page 12 of 27 <br /> <br /> <br />
