inquired as to why the City is going with a three-phase pump rather than a single-phase pump. <br />Mr. Hartley replied that a three-phase pump is more cost-efficient than a single-phase pump and <br />three-phase pumps and replacement parts are more readily available than with single-phase pumps. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case <br /> <br />North Forty Addition Trail Corridor. <br /> <br />Mr. Otto recalled that in May, residents came before the Council and expressed concern regarding <br />the proposed use of a drainage easement in North Forty Addition for a trail corridor. At that time, <br />City Council directed City Staff to work with the residents of North Forty to resolve the conflict. <br />Mr. Otto stated that he met with the concerned residents on several occasions and identified four <br />options: 1) utilizing County Road #83 right-of-way to the extent possible and minimizing the <br />amount of right-of-way required for trail within the drainage and utility easement through North <br />Forty. The three property owners involved in the discussions were unanimously opposed to <br />Option #1 and virtually any use of the drainage easement at all for trail corridor. The second option <br />discussed was the dedication of land for trail on the Armstrong Addition parcel immediately west <br />of the North Forty. Due to the low density, however, park dedication on Armstrong Addition was <br />limited to 1.3 acres, all of which was required to traverse the property in the east/west direction <br />thus leaving no acreage for a north/south corridor adjacent to the North Forty, therefore this is not <br />a viable option. The third option discussed was purchasing property interest either on the <br />Armstrong Addition property or within the drainage and utility easement. In discussing the matter <br />with the City Assessor, John Keefe, it appears that purchasing additional property interest within <br />the drainage easement would be less expensive than replacing the trail corridor by outright <br />acquisition within Armstrong Addition. With the homeowners at this point being adamantly <br />opposed to use of the easement for a trail corridor, it appears that a condemnation action would be <br />required to acquire the property. The fourth option involves taking no action at this time since trail <br />construction is imminent. Since the City already retains the drainage easement, the homeowners <br />are prohibited from making any improvements in that easement and there is no imminent need for <br />the City to take action at this time. <br /> <br />Susan Allen - 7950 - 163rd Lane N.W. - stated that her and other concerned residents are in favor <br />of a bike trail but they have a real concern with horses utilizing the trail. <br /> <br />Doug Opsahl stated that the proposed trail will affect the saleability of his home because the <br />easement is laid out quite close to his house. Mr. Opsahl also inquired if he is obligated to tell <br />perspective buyers about the proposed trail through his property. Mr. Goodrich stated that Mr. <br />Opsahl can market the home and state that there is an easement for utility and drainage and he can <br />also inform the perspective buyer that the City has discussed a trail corridor within that easement. <br />Mr. Goodrich explained that cities have the authority to acquire property for public use at any time <br />with anyone's property. Mayor Reimann stated that he hopes there is some way to resolve this <br />problem and that he feels a trail system would be an amenity to the homes in the area. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to take no action at <br />this time with respect to the trial corridor through the North Forty Addition. <br /> <br />Motion carried.
