Case #17 <br /> <br />Resolution Authorizing the Acquisition of Right-of-Way for the Construction of <br />153rd Avenue N.W. (Improvement Project #89-4). <br /> <br />Mr. Goodrich presented a proposed resolution authorizing the acquisition of right-of-way for <br />construction of 153rd Avenue N.W. Mr. Goodrich also noted that with one parcel, the City only <br />desires to obtain a permanent easement versus fee title because there is a potential for ground water <br />pollution on that parcel. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca to adopt Resolution <br />//90-06-195 Authorizing Acquisition of Certain Property by Use of MSA 117.011 and 117.042 for <br />Street and Utility Purposes for Construction of 153rd Avenue N.W. <br /> <br />Further Discussion: Councilmember DeLuca requested statistics on the number of parcels to be <br />negotiated with. Mr. Goodrich replied that there are 19 parcels involved in right-of-way <br />acquisition. Ten of those acquisitions have been resolved and nine will have to go to <br />condemnation. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers Pearson, DeLuca, and Cich. <br />Voting No: None. Abstained: Councilmember Peterson. <br /> <br />Case #18: On-Sale Liquor License Renewal for Jimmy B's. <br /> <br />Police Chief Auspos stated that the owners of Jimmy B's have provided the necessary information <br />required with application for an on-sale liquor license renewal. However, the fee required along <br />with the license application was just paid on July 10, 1990 and in addition to that, the State has <br />issued a hold order on the issuance of a license to Jimmy B's. Police Chief Auspos inquired if <br />Council would consider approval of the on-sale liquor license contingent upon the State lifting its <br />hold order and making sure the check from Jimmy B's clears the bank. Chief Auspos noted that <br />Jimmy B's will not be allowed to operate as of midnight on June 30th if the hold order is not lifted. <br />Councilmember DeLuca inquired as to the reason for the State issuing a hold order on the liquor <br />license. Police Chief Auspos replied that the hold order was issued as a result of non-payment of <br />unemployment tax and back property taxes. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to approve the <br />renewal of the on-sale liquor license for Jimmy B's contingent upon the applicant meeting all State <br />and City requirements and receipt of a release of hold order from the State by 5:00 p.m. on June <br />29, 1990 at either the Ramsey Municipal Center or the office of City Attorney Bill Goodrich. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmember Pearson, Peterson, Cich and <br />DeLuca. Voting No: None <br /> <br />Case #19: Block Parties. <br /> <br />Planning Assistant Frolik stated that City Staff is anticipating receiving more requests for block <br />parties in the future and is recommending that City Council grant the Police Department the <br />authority to grant block party permits. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember DeLuca to direct City Staff to <br />draft a policy on block parties authorizing the Police Department to grant permits for same. <br /> <br />Motion carried.
