This subdivision may be amended whenever the public necessity and <br />2221 the general welfare require such amendments by the procedure specified in <br />2222 this subdivision. Amendments to this subdivision must be certified by the <br />2223 I commissioner as specified in subsection (0(10) of this section. <br />2224 <br />2225 b. Requests for amendments of this subdivision shall be initiated by a <br />2226 petition of the owner of the actual property; or by action of the council. <br />2227 <br />2228 c. An application for an amendment shall be filed with the zoning <br />2229 authority. <br />2230 <br />2231 I d. Upon receipt in proper form of the application and other requested <br />2232 materials, the planning commission shall conduct a public hearing in <br />2233 the manner prescribed in article II, division 2 of this chapter. <br />2234 <br />2235 e. Following the public hearing, the planning agency shall make a report <br />2236 of its recommendations on the proposed amendment and shall file a copy <br />2237 with the council within 60 days after the hearing for the city council's action. <br />2238 Certification from the commissioner must be obtained as specified in <br />2239 I subsection (0j)(10) of this section before the proposed amendment becomes <br />2240 effective. <br />2241 <br />2242 f. To defray the administrative costs of processing requests for an <br />2243 amendment to this subdivision, a fee not exceeding administrative costs shall <br />2244 be paid by the petitioners. Such fee shall be determined by the council. <br />2245 <br />2246 (9) Conditional use permit review. <br />2247 a. A copy of all notices of any public hearing, or where a public hearing <br />2248 is not required, a copy of the application to consider issuance of a conditional <br />2249 use permit shall be sent so as to be received by the commissioner at least 30 <br />2250 days prior to such hearings or meetings to consider issuance of a conditional <br />2251 use permit. A copy of the decision shall be forwarded to the commissioner <br />2252 within ten days of such action. <br />2253 <br />2254 b.
