2175 b. Substandard signs shall be gradually eliminated over a period of time <br />2176 not to exceed five years from the date of enactment of the ordinance <br />2177 from which this subdivision is derived. <br />2178 <br />2179 c. Where a setback pattern from the ordinary high water level already <br />2180 has been established on both sides of a proposed building site, the <br />2181 setback of the proposed structure may be allowed to conform to that <br />2182 pattern. This provision shall only apply to lots that do not meet the <br />2183 minimum lot width requirement of ccction 117 256 subsection (d) of <br />2184 this section. <br />2185 (6) Variances. The grantin�c of a variance requires the presence of the following <br />2186 conditions: <br />2187 a. The strict enforcement of the land use controls will result in <br />2188 unnecessary hardship. <br />2189 <br />2190 b. Granting of the variance is not contrary to the purpose and intent of <br />2191 the zoning provisions herein established by these standards and <br />2192 criteria, and is consistent with Minn. Rules pts. 6105.1400- <br />2193 6105.1500. <br />2194 <br />2195 c. There are exceptional circumstances unique to the subject properties <br />2196 that were not created by the landowner. <br />2197 <br />2198 d. Granting of the variance will not allow any use which is neither a <br />2199 permitted or conditional use in the land use district in which the <br />2200 subject property is located. <br />2201 e. Granting of the variance will not alter the essential character of the <br />2202 locality as established by Minn. Rules pts. 6105.1400-6105.1500. <br />2203 <br />2204 (f) All variances to the requirements of this subdivision must be certified <br />2205 in accordance with subsection (g) of this section. <br />2206 <br />2207 (7) Plats. <br />2208 a. Copies of all plats within the boundaries of the Scenic River Land Use <br />2209 District shall be forwarded to the commissioner within ten days of final <br />2210 approval by the city. <br />2211 <br />2212 b. Inconsistent plats: Approval of a plat which is inconsistent with this <br />2213 subdivision is permissible only if the detrimental impact of the inconsistency <br />2214 is more than overcome by other protective characteristics of the proposal. <br />2215 <br />61 <br />
